I understand that an investigation is being conducted by Kroll Associates (UK) Limited (“Kroll”) on behalf of the Council. Kroll are undertaking an independent, fact-finding review of the circumstances and decision-making process leading up to and following the Council’s approval for Brick by Brick Ltd to undertake the refurbishment of Fairfield Halls.

Freedom of Information Request

 

Your request has been considered under the provisions of the Freedom of
Information Act. Please accept our apologies for the lengthy delay in
responding to you. Specifically, you have requested the following
information:

 

I understand that an investigation is being conducted by Kroll Associates
(UK) Limited (“Kroll”) on behalf of the Council. Kroll are undertaking an
independent, fact-finding review of the circumstances and decision-making
process leading up to and following the Council’s approval for Brick by
Brick Ltd to undertake the refurbishment of Fairfield Halls.

Please provide a copy of Kroll’s report.

 

Under the Freedom of Information Act, the council must consider requests
up to and including the date a request for information is received.  The
council however is not required to disclose changes to information, or new
information, after the date a request is received.

We received your request on 19 December 2022 and at that time the Kroll
Fairfield Halls report had not yet been finalised and received by the
Council. Therefore, at the time of your request this information was not
held by the Council.

By way of update, the Kroll Fairfield Halls report was finalised and
received by the Council on 9 March 2023 and it was considered by the
Council’s Appointments and Disciplinary Committee (‘the Committee’) on 23
March 2023. However, as an exception to the general rule, because the
Kroll Fairfield Halls report is a confidential document it has not been
published by the council or made available for public inspection. Further,
to maintain the confidentiality of the Kroll Fairfield Halls report, when
the Committee discussed it in detail it did so in private.

The Kroll Fairfield Halls report is confidential because it contains a lot
of personal data which it would not be appropriate or fair to disclose at
this stage in the decision-making process.

In addition, on 23 March 2023, the Committee agreed to the Kroll Fairfield
Halls report being referred to the Met Police and relevant professional
bodies for their consideration as to whether any further action is
warranted. Publication of the Kroll Fairfield Halls report therefore would
or, would be likely to prejudice those processes.

We thought we would take this opportunity to outline the reasons for the
confidentiality of the Kroll Fairfield Halls report. However, as the
council does now hold this information, you are entitled to submit a new
information request which the council would properly consider on its
merits before deciding whether or not to comply with your request.

 

 

The Council publishes Access to Information requests and responses on its
