The issueing of new guidance following clarification given in Admin Court.
Dear Home Office, a question for Mr. Peter Spreadbury at the Police Pensions Department.
In regard to the Police Negotiating Board - Agreement 10/4 in 2010, the GUIDANCE contained in 4.3 of that PNB - Agreement states that the term - PERMANENT - in regard to Ill Health Retirements means for LIFE.
In the Admin Court Case of SCARDFIELD in 2013 the Court gave clarification to the interpretation of the term - PERMANENT.
As the Police Negotiating Board is now defunct, will the Home Office - Police Pensions Department be revising its earlier GUIDANCE to take into account the Admin Courts interpretation of the term - PERMANENT in the case of - SCARDFIELD.
Also, will the Home Office be issuing new GUIDANCE forthwith to Police Pension Authorities and to Police Medical Appeal Boards on the interpretation of the term - PERMANENT as set out in the Admin Court Case of - SCARDFIELD.
Yours faithfully,
W. Evans.
