The Involvement of the Royal New Zealand Navy in the British Nuclear testsing programmes of 1957 and 1958.

Dave Whyte made this Freedom of Information request to Ministry of Defence

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by Ministry of Defence.

Dear Ministry of Defence,

On page 23 of the above publication, the last paragraph reads:

" Apparently before each nuclear test the crewmen were issued with a new film badge and after the test they would be collected and sent for processing on HMS NARVIK. However, during Operation Grapple most film badges including those from the New Zealand frigates were not processed, principally because of problems with storing the chemicals needed for processing."

Can you please supply me with copies of letters from HMS NARVIK stating this fact?

Yours faithfully,

D.Whyte

CIO-FOI (MULTIUSER),

DE&S Secretariat

Dear DES SEC-PolSecShips and Subs (MULTIUSER),

Thank you for the reply you gave regarding my request for copies of letters sent by HMS Narvik regarding their inability to process the radiation film badges supplied by the Royal New Zealand Navy.

You quote a letter dated 24 February 2011 (5 Years ago) then have the audacity to call this request 'VEXATIOUS'.

Your letter states 'If you are not satisfied with this response or you wish to complain about any aspect of the handling of your request, then you should contact me in the first instance'.

I am not satisfied with your response. The request I made, was in relation to the processing of film badges.
Once again you have failed to give your name so I am unable to address you personally

Yours sincerely,

Dave Whyte

Dear DES SEC-PolSecShips and Subs (MULTIUSER),

Having considered this matter fully, I wish to have an internal review regarding this request, prior to placing it in front of the Information Commissioner.

Yours sincerely,

Dave Whyte

CIO-FOI-IR (MULTIUSER),

Dear Mr Whyte,

Freedom of Information Act (FOIA) Internal Review

We acknowledge your e-mail below. The MOD Information Rights Compliance
Team will conduct an internal review of your request for information, our
reference FOI2016/00269.

The Department's target for completing internal reviews is 20 working days
and we therefore aim to complete the review and respond to you by 2 March
2016. Whilst we are working hard to achieve this, in the interests of
providing you with a realistic indication of when you should expect a
response, we should advise that the majority are currently taking between
20 and 40 working days to complete.

The review will involve a full, independent reconsideration of the
handling of the case as well as the final decision.

Yours sincerely,

MOD Information Rights Compliance Team

Dear CIO-FOI-IR (MULTIUSER), It was stated that the Internal Review for this Topic would be supplied by the 2nd March 2016, can you please explain the delay?

It was 'YOUR' decision to take discriminatory action, and label this request as 'VEXATIOUS' under section 14 of the FOIA. There is nothing further to investigate other than your own decisions.

I await your Internal Review.

Yours sincerely,

Dave Whyte

This request refusal was sent to the Information Commissioner on the grounds that the Ministry of Defence refused to supply any information and regarded the request as 'VEXATIOUS'. I dispute this remark but the Information Commissioner appears to be siding with the MOD.

If any person wishes proof, they can look back my requests and view the answers given by the MOD. They will notice that any article I have requested that relates to the levels of radiation are immediately classed as 'VEXATIOUS.'
