Dear Mr Palmer,

All Information Held Concerning the Independent (Russell) Review

You have given me, under your reference FOI_10-144, some details of the contractual terms under which Sir Muir Russell carried out his Independent Review of the leaked UEA email matter. Clearly all the information held by Sir Muir Russell and his team was created and received on behalf of the University of East Anglia and at a substantial cost to public purse. It is therefore "held" by the University within the meaning of the EIR.

It is without doubt “environmental information” in so far as it illuminates the process by which globally important scientific assessments are made and examined, based upon which drastic reductions in “emissions” are being imposed upon the public much to is financial disadvantage. The link to “emissions” disengages almost all possible exceptions to disclosure.

I have been advised by the University of Edinburgh that in July 2010, the month in which the ICCER (Russell) Report was published, all Russell Review information was “centralised” by the ICCER. The University of Edinburgh has disclosed that it was contracted by Sir Muir from 23 February 2010 to provide the services of Professor Clarke. It has also confirmed that that its facilities including email were also used by Professor Boulton.

The University of Edinburgh has also advised that it no longer holds information that I requested. I am appealing this matter, but in the meantime request copies of all the information held by the Independent Review carried out by Sir Muir Russell on your behalf and at public expense. This will include but is not limited to the basis upon which the Review refused to publish my submission to it and information on how grotesquely altered parts of it were entered into the public record of the Review.

I would ask that the University immediately take whatever steps are necessary to ensure that no documents or information pertaining to the Review are deleted by Sir Muir or at his instruction or with his consent.

Re: FOI_11-022

Dear Mr Palmer,

I refer to your letter of today’s date in respect of FOI_11-022 and am asking that the University thoroughly and independently review its decision not to release all the information held on the University’s behalf by the contractor(s) undertaking the Independent Climate Change Email Review (ICCER).

I am presuming that the reason you are claiming not hold it is that as stated in today’s response to my appeal against your ruling on FOI_10-144. This is that despite having disclosed an agreement and substantial payments of public funds to Sir Muir Russell or settle fees incurred by him you claim that no contract existed between the University and him. I believe you should carefully reconsider this.
