Dear David

 

Thank you for your request for information* dated 16^th September 2014.
Your request has been logged and dealt with under the Freedom of
Information Act 2000.

  

I can confirm that we hold the information, but after careful
consideration have decided that the following exemptions apply:

 

o Section 41 – information provided in confidence relating to contracts;
and
o Section 43(2) – commercial detriment of third parties

 

The terms of the agreement include a non-disclosure clause which covers
all information provided by Google to the Authority.  The agreement
relates to the use of equipment which is unique to Google operations and
therefore provides a strong argument that any disclosure may prejudice
Google’s commercial interests.

 

Sections 41 and 43(2) are ‘qualified’ exemptions and I am obliged to apply
the public interest test. The Authority is committed to openness and
transparency in the carrying out of its functions, but on this occasion,
has decided that the public interest in disclosure of the requested
information does not outweigh the public interest in withholding it. The
Authority considers disclosure would compromise the commercial position of
the company providing the product and associated services and would breach
the terms of the agreement into which the Authority has entered.  In
reaching its decision the Authority has considered the relative weight of
the arguments for and against disclosure, the likelihood and severity of
any prejudice, the age of the information, how far the requested
information will aid public debate and understanding; and whether similar
information is already in the public domain.  

 

I trust that you understand the Authority’s reasons for withholding the
information. However, if you are not happy with the decision you have the
right to appeal through the Authority’s complaints procedure by contacting
