I can confirm that the Council holds this information. This information is
exempt under section(s) under Section 43(1)(2) of the Freedom of
Information Act and is therefore being withheld.

 

We have withheld:

 

o a copy of the contract between Enfield Council and Film Office
o how much are they paid
o If they are paid a flat fee or commission

 

 

Under Section 43(1)(2) of the Freedom of Information Act. Under Section
43, information is exempt from disclosure as releasing it would, or would
be likely to prejudice the commercial interests of any person (including
the public authority holding it). In our view, disclosure of the contract,
rates and fees would be likely to undermine the Council’s ability to
negotiate favourable rates on behalf of residents and consequently weaken
their bargaining position in the market place.

Section 43 is a qualified exemption therefore we have to consider the
public interest in disclosure. We acknowledge that the public interest is
served by promoting transparency by public authorities for decisions taken
by them so that individuals can understand the basis of those decisions
and, in some cases, assisting individuals in challenging them. However, in
this instance, we consider that there is a greater public interest in
protecting the confidentiality of commercially sensitive information,
which could, if disclosed, damage companies’ commercial interests and
potentially undermine the Council’s ability to negotiate favourable rates
on behalf of residents. Therefore, we have decided that in this case the
public interest lies in favour of withholding the requested information.

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to:

Dear Abdul Hai,

Further to our previous correspondence, the above case has now been allocated to me.

Please accept my apologies, on behalf of the ICO, for the long delay in allocating this complaint. The ongoing burden of the pandemic is causing our existing cases to take longer to resolve - and this has a knock-on effect on the speed with which we are able to pick up new cases.

Given the length of time that has elapsed since this case was accepted, I would be grateful if you could confirm that you still wish to pursue this matter. We are aware that circumstances may have moved on considerably in the intervening period and, as a publicly-funded body, we have a duty to prioritise our resources towards those cases where we can make the most difference.

Please let me know is soon as possible if you still wish to move this matter forward. I will then write to you setting out the formal scope of the complaint. If I do not hear from you by Monday 24 January 2022, I will assume that you no longer wish to pursue this matter and will close the case accordingly.

Further to my previous correspondence, the London Borough of Ealing has reconsidered its position and now wishes to issue a fresh response to your request. Unfortunately, because of the passage of time, the whatdotheyknow.com thread has been archived and, whilst it is still visible, it is not accepting any new correspondence.

So that the Council can provide you with its response, you can either:
