information you are requesting?

 

The Freedom of Information Act does not cover opinion or judgement
relating to information that does not already exist.

 

You seem to be asking for confirmation of the existence of tunnels and
rooms? Are you referring to school class rooms? Which tunnels are you
referring to?

 

We would be grateful if you can clarify exactly what information you are

Upon receipt of your clarified request we will resume the Section 10

Thank you for your e-mail timed at 22:51 of the evening of 22nd May. I apologise for the delay in our response however as the school closed at 17.00 on 22nd May for half term. Regulations 3(2)(a) and 3(2)(b)of The Freedom of Information (Time for Compliance with Request) Regulations 2004 makes provision to disregard from the from the FOI timescale any working day which is not a school day. We therefore received your email on Monday 1st June.

We consider your email a significantly different question however and we require further clarification as per Section 1(3) of the Freedom of Information Act 2000

In relation to your new question, your previous request asked “The existence and location of any and all tunnels, and rooms within the school and surrounding grounds”. Whilst we can of course confirm there will not be, are not, nor ever have been any tunnels within or under the school and surrounding grounds, we consider that your new request is significantly broad with regard to its scope.

Your request is now seeking:-

Any and all:-
Maps, plans, drawings showing the school, school grounds, including under the school, and under the school grounds, including maps, plans, drawings showing parts of;- the school, school grounds, under the school and under the school grounds.
Records, including correspondence, invoices, purchase orders etc. of any and all remodelling, and or changes in use of areas of the school, school grounds including under the school and school grounds.

As it stands we must give consideration to the potential vexatious aspect of this request as per Section 14(1). The request appears to be part of a completely random approach solely designed for the purpose of ‘fishing’ for information without any idea of what might be revealed. That aside, and were this not an issue, the volume of different type of document sought without any clear parameters would likely engage the cost limit of Section 12 of the Act if we attempt to locate them.

Can you please clarify if there are specific documents you are seeking and to which period your request relates?

I appreciate your concerns, especially with respect to wasting public funds. I will narrow the scope, and clarify the documents/time periods.

The object of the request is to determine whether or not there are any tunnels and/or other structures in or under the school and school grounds of which the public are, or may be, unaware.

There is no intention to make a vexatious request, and neither is this request 'fishing'. The request was and is for specific categories of documents, the search was narrowed to those which contained information relevant to the request.
I was not anticipating that there would be any substantial volume of different types of documents, or documents themselves, which would be relevant to the request.

This being said, I will ask you the following, and hope you find this a more reasonable request, and that it is within your guidelines to comply with. The format can be the most expedient for you, provided it is legible.

How many maps, plans and drawings of the school and school grounds, (including under the school and school grounds), are on file?

Are there a list(s) or record(s) of them? If so, will you provide copies?

How many instances of remodelling, redecorating and or changes in use, have there been in the previous 3 years, and in the previous 15 years?

Are there a list/s or record/s of them? If so, will you provide copies?

What is the date of the most recently updated complete set of building blueprints/technical plans?

Does it include foundations, footing and any underground structures/utilities?

Does the school have a copy? If so, will you provide a copy?

In the event that you do not have any of the above information, will you direct me to the appropriate authority?

We are writing with regard to your email of 5th June.

Before I continue I wished to reiterate that we adhere to the requirements of the Freedom of Information Act 2000 and what that legislation determines as vexatious, excessive and / or ‘fishing’. They are not our guidelines and our opinions are irrelevant to that effect. Further information about the Freedom of Information Act is available on the Information Commissioner’s website www.ico.org.uk

However, we have twice sought clarification and each time a sufficiently different request has returned. The Act requires us to both seek the appropriate clarification and assist you where we are aware that a request will exceed the cost limit of the Act or likely be exempt. The Freedom of Information Act is applicant blind and whilst we appreciate the explanation for the purpose of your request it does not affect the handling of your request, the communication thus far nor will it affect any future correspondence of our final response.

You have stated, “The object of the request is to determine whether or not there are any tunnels and/or other structures in or under the school and school grounds of which the public are, or may be, unaware”.
I would like to take this opportunity to be absolutely clear that, and as per our previous correspondence, we can confirm there will not be, are currently not, nor ever have been any tunnels or hidden structures within or under the school and surrounding grounds in the last 15 years or longer.

Can you please confirm that this is neither a sufficient response nor explanation and that you wish us to continue with the remainder of your request, that being copies of maps and drawings that we may hold to the extent of:-

We do not consider 15 years to be a narrowed search and you should be aware of the cost limit as prescribed by Section 12 of the Act and the reasonableness of Regulation 12(4)(b) of the Environmental Information Regulations 2004 under which this request may likely fall once we receive confirmation that you wish us to proceed. Should the request significantly change again we will consider that in line with the requirements of the Freedom of Information Act and will seek further clarification should we need to.

Information Regulations 2004 in so far it is information defined by
