Dear Welsh Book Council,
1] Are you subject to the Public Sector Equality Duty?
2] How have you collected information on equality, diversity, and inclusion in line with the Equality Act 2010? Please provide examples of your equality, data, and monitoring forms.
3] How have you collected information on the distribution of funds to authors with protected characteristics under the Equality Act 2010 from 2010-2021?
3.1] How have you collected information on the distribution of funds to authors from a non-Black, Asian, and Minority Ethnic background, and how have you collected information on the distribution of funds to authors from a Black, Asian, and Minority Ethnic background?
3.2] How many BAME and non-BAME authors have you supported over the past 10 years? Please provide this information year on year.
4] How have you collected information on the distribution of funds to Welsh language speaking authors?
5] What is a "diverse ethnic background" based on WBC guidance?
6] Is WBC audited on EDI by any bodies who fund it, such as Creative Wales or the Welsh Government?

We write further to your email of 20 July containing a number of questions that you have asked us to answer, under the Freedom of Information Act (2000).
As you may be aware, a requester may ask for any information, which is held by a public authority, in accordance with the provisions of the legislation.
The Books Council of Wales is not a public authority. Rather, it is a charity, registered, under charity number 1192269. In this regard, the provisions which provide for any third party to make a request for information under the FOI legislation do not apply.
In relation to the specific questions that you have now asked, we are not in a position to provide you with a substantive response, as this would be a disproportionate use of finite and limited resources, better utilised in support of our organisational aims.
We regret that we are unable to assist you with your requests at this time.

Dear Castell Brychan,
Thank you for your response on 25th July on whatdotheyknow.com to my FOI request "The Equality Act and Support of BAME authors".
BCW has received some Freedom of Information requests through the website including "application from Golwg360", "Funding Support', and "Information about your dealings with Stonewall [Extraneous material removed]" from 2014-2021". I noticed that being a charity, and not a public authority, there had been some evidence of third party requests to information under FOI legislation to BCW that BCW had fulfilled, which led to me asking, while I appreciate that you are not in a position to send me a substantive response.
