Please note, the following applies, if the response includes council
officers (or other officers) names.

If you are a company that intends to use the names and contact details of
council officers (or other officers) provided for direct marketing, you
need to be registered with the Information Commissioner to process
personal data for this purpose. You must also check that the individual
(whom you wish to contact for direct marketing purposes) is not registered
with one of the Preference Services to prevent Direct Marketing. If they
are you must adhere to this preference. You must also ensure you comply
with the Privacy Electronic and Communications Regulations (PECR). For
more information follow this Link [3]www.ico.org.uk

For the avoidance of doubt the provision of council (and other) officer
names and contact details under FOI does not give consent to receive
direct marketing via any media and expressly does not constitute a ‘soft
opt-in’ under PECR.

Dear Derby City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Derby City Council's handling of my FOI request 'The Christmas Market - Market Hall - 7th December 2019'.

My request was refused and the Council stated; - "Section 40(2) Personal data third party exemption applies to the names of employees below senior management level". However, a risk assessment contains a lot of other information other than people's names. Although it maybe a requirement for a risk assessment to state who is responsible for certain tasks etc. this only has to be written down as a job role and if the Council's risk assessment for this event did include names of it's employees they could be redacted to fulfil this request.

The request relates to precautions and procedures to facilitate the safe running of an event. This information can be supplied without naming any Council employees.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/t...

Yours faithfully,

Lewis Foxhall

FOI, Derby City Council

Dear Lewis Foxall,

Thank you for complaint about how we dealt with your Freedom of Information Request FOI 13887.

In accordance with our FOI complaints procedure your complaint has been allocated to our investigating officer to carry out the internal review.

The Information Commissioner's Office (ICO) guidance states that FOI internal reviews should take no longer than 20 working days.

The internal review decision will be sent to you by 16/03/2020.

However, there may be occasions when it will take longer due to the volume of files involved/complexity of the issue and the workload of the investigating officer. We will let you know if this is the case.

The investigating officer will either uphold the original decision; provide an additional explanation of the exemption/exception applied; or release further information if it is considered appropriate to do so.

You may also apply to the Information Commissioner for a decision under section 50 of the Act but he may decline to deal with your application if you have not followed the Council’s complaints procedure first.
