The Alleged Falsification/Alteration of Patient Records'Wiltshire Report'

Waiting for an internal review by Avon and Wiltshire Mental Health Partnership NHS Trust of their handling of this request.

Dear Avon and Wiltshire Mental Health Partnership NHS Trust,
Several years ago there was a major 'independent' investigation into the alleged falsification/alteration of patient records at AWP.
Following the worrying revelations of that report, I now understand a further investigation was carried out, maybe with the involvement of the commissioners of services or others that regulate you, to ensure that no one including patients had been harmed regarding the extensive findings of the main reports, and a further report was commissioned that was supposed to investigate IF any patient or other was harmed due to the goings on at AWP.
I wih to see a full duplicate copy of the report that was completed that was supposed to check if ANYONE had been harmed following the revelations in the report, and all of the notes / records that you hold where senior oficials of your trust including the board of management dealt with the information found in the original reports, and of course the final investigation to see if anyone had been harmed or affected.
I am a former patient that revealed the original report, and has suffered ongoing harm ever since.

Thank you for your initial response, but this document ( a main report dated 06 November 2012 ) is not what I asked for, however it has raised further concerns regarding the completeness of the content of the document you have now provided, as I have others of a similarly titled report that show a number of different dates on the front cover ??
Would you please provide me with duplicate copies of ALL the reports you hold titled ' Independent investigation report into the alleged falsification and / or alteration of service user records - Avon and Wiltshire Mental Health Partnership NHS Trust ' . It appears they have numerous different dates shown on the front cover of the report and I think it likely the content of each differs ?
It always worries me when AWP and others repond to a FOIA request excluding the name of the FOI Team member responding , this has often happened in the past when information I was entitled to receive has not been provided.
Within your initial response letter dated 21 June 2021 under the section you titled ' You requested the following information ', 3 paragraphs ', it clearly repeats the information I asked to see, but that has not yet been provided.
I therefore ask you to provide the full information I am asking for within this request without further delay ?

You should make yourselves aware again, that I have used the whatdotheyknow website to ask for the
main report dated 30th August 2012 on 1. 15 September 2013 2. 24 October 2013 3. 02 November 2013
4. 26 November 2013 5. 21 April 2017. I regret to say AWP have not previously complied with my FOIA Rights regarding these past requests, and ask you to make 'Reasonable Adjustments ' now under Equality and Disability Legislation to ensure I receive ALL the information I am now asking for. Please ensure you do not continue to give me the run around as this causes me harm to my health and wellbeing, and damage and distress that makes my mental health significantly worse where I remain untreated.
Your medical records regarding myself are substantially incomplete.

I believe it is essential that I receive Justice now, so I can see how the powers that be above you have taken all steps they could to support any of your patients that may have suffered any mental health or other injury as a result of the real and true incidents occurring at AWP during this period and subsequently

I am writing to request an internal review of Avon and Wiltshire Mental Health Partnership NHS Trust's handling of my FOI request 'The Alleged Falsification/Alteration of Patient Records'Wiltshire Report''.

The final pages of the report you sent me, pages 20 - 28 I believe - the ones that are blue coloured, clearly show what was required of you by the Strategic Health Authority, and would have formed the ' lesons learned ' by AWP - are you telling me the lessons learned and the other benefits of this report to help you improve have not been kept or implemented by your trust ?

I ask you to look again at the carefully worded request I submitted, and pay particular attention to the terms of reference set by your commissioners of services and the strategic health authority on pages 20-28 of the report you sent me, which identify the information I wish to see.

Further to my request for a review of the handling of this request made on Friday, on Monday 26th July you provided your response which is disappointing to say the least.
I had expected AWP to make the necessary ' Reasonable Adjustments ' under Equality and disability Legislation, due to my 20 years of untreated mental health injury, my other disabilities , my being a vulnerable adult , a pensioner and of course a service user of your trust at the time a large number of social workers 'whistleblew' regarding what they saw as falsification and alteration of patients records at AWP.
As you know, my own records were among those that I KNOW were altered, and I have been subjected to what appears to be a multi agency cover up for very many years now.
I have read appendix 1 of the report you sent me, I do not understand why it was not provided in response to my earlier requests as it was certainly available to you at the time - it appears to me when I make a FOI request, you ignore my Legal Rights and Legislation, and adopt damage limitation procedures by not providing me with information I am Legally entitled to see - you have never explained why the information identified on pages 19 - 27 of your report has not been supplied by you on each occasion you have responded to me - there are many documents identified , but not supplied in your responses.
In your review response letter dated 26 July 2021 - bullet points, you state " the Trust had sent you all of the information that was available ", yet clearly that is not the case as the current appendix confirms.
Indeed your trusts handling of my requests on this matter are all shown on the whatdotheyknow website,
and to say the least leave a lot to be desired if you carefully check each response.
Due to my mental health injuries, and other ill health that has come on where I am unable to get a lot of my Legal Rights from you - hence no resolutions or apologies or support or treatment from you, I still believe I am being subjected to abuse and neglect by you at least under adult safeguarding.
The Trust has had duties under many Acts to me for some 20 years now, since death threats against me appeared in your records, and my name regularly cropped up in your records - even before I before I eventually became an outpatient of your trust.
Your ' HANDLING ' of me now in your responses, and of course over many years now , leaves me in urgent need of support due to the damages you have caused me.
I am disempowered ( meaning deprived of power, authority or influence, made weak, ineffectual and unimportant, you have removed confidence from me 0 to obtain my FOIA ights and to get the treatment that was once agreed for me - then withdrawn by your trust knowing the damaging true facts about you were likely to come out.
I am frustrated ( meaning prevented from progressing or succeeding or being fulfilled , caused to have no effect, bring my requests to nothing , to make someone feel annoyed and impatient by preventing them from doing or getting something , to upset , to agitate , to confuse and torment me deliberately for more than TEN YEARS NOW ) .
I am marginalized ( treat a person as insignificant , reducing the seriousness of matters raised to a lower limit , edged out ,relegated to lower levels in your trust, placed in an unimportantant and powerless position by yourselves. I know I am poor , disabled , elderly and have experienced VERY SERIOUS FAILINGS in your trust due to my mental health injuries that have further deteriorated since diagnosis by yourselves TEN YEARS AGO , and treatment being denied.
Thank you to the High Court for this information contained within a case won by the complainant under the Human Rights Act Legislation, Well done Katie Rowley and Frys Law.
So clearly for some 20 years now, your actions have effectively destroyed my life, continued to seriously damage my health and wellbeing and taken away my Rights to treatment and so many other things.
I think you should review your review, and pass this email to your CEO please, and the latest Board of Management.

I refer you initially to your response to my 'review' request under FOIA.

I am sorrry I still have the NEED to re raise this matter, but my health and wellbeing and my mental and physical ill health are being adversely affected by you as a NHS provider, and this has been the case since around 2011 - I am attempting to gain your assistance for me to start on the road to recovery and the truth and being able to maybe trust you a little bit might help ?

Your three ' bullet points ' list :

the Trust had sent you all of the information that was available - but of course through using the excellent
whatdotheyknow website for over 10 years now, you have NEVER provided me with the comprehensive and
detailed information I have listed in my requests over the 10 years period, it is clear to me that you deny me my Rights under Legislation and FOIA - that is clearly shown on this website.
Why do you break the Law and deny me my Rights, making me more ill in the process and denying me the
opportunity to get well following your many failings commencing in 2011 ?

the information the trust holds is publicly available on our website - as you know, I am not into using computers and modern technology due to my mental ill health, please provide all of the information that you claim to be on your website as I cannot access it from the - zip box - of documents numbered 249 - 03 to 249 - 13 and 249 - that are listed. The documents I am particularly interested in are clearly identified on pages 20 - 28 of the report, but have NEVER ben provided to me over the 10 years or so that I have been asking for them so please provide them now.

YOUR MAIN COMMISSIONER OF SERVICES , BRISTOL NORTH SOMERSET AND SOUTH GLOUCESTERSHIRE NHS CLINICAL COMMISSIONING GROUP ( Lisa Manson, the Director of Commissioning ) when requesting the information described on pages 20 - 28 of the report " This information would be held by Avon and Wiltshire Mental Health Partnership NHS Trust : " , thank you for their communication dated 11 August 2021.
Is one of you not telling me the truth again ?
Your ongoing failures to deal with the injuries you have caused me are destroying my health and wellbeing
for far too many years now, please rectify this serious ongoing situation ?

the Trust has dealt with several previous requests from you regarding this subject - I have informed you of my previous requests about the Alleged Falsification / Alteration of Patient Records ' Wiltshire Report ' , but this request is for specific information contained within the main report in appendix 1 on pages 20 - 28, and this is the first occasion I have specifically asked for the information contained within this appendix 1, as I feel I need to see how seriously you deal with such serious matters that could cost innocent members of the public their lives .
To date I have received not one reassurance from you in the past 10 years - maybe afailing organisation that does not learn from its errors and ommissions, very costly to the innocent public.

You state " We regard this request as closed " , I regard it as further refusal to comply with Legislation my Rights, NHS Policies and Procedures on dealing with such matters, the NHS Constitution , AWP Policies and Procedures , the requirements placed on you by your Commissioners of Services and your ongoing Abuse and Neglect of a disabled vulnerable adult under Adult Safeguarding, and ongoing further damage to my Health and Wellbeing - by an NHS PROVIDER !!

I again ask you for 'reasonable adjustments ' under Equality and Disability Legislation to resolve these matters , in the absense of AWP making reasonable adjustments, will you pay for a solicitor to represent me to help you put right your very serious wrongdoings over many years ?
