The 2nd 2015 report from the MPA

Dear High Speed Two (HS2) Limited,

If I understand the sequence correctly, the Major Projects Authority produce two annual reports on HS2. I submitted request to you earlier in the year (FOI15-1380) regarding the first one in 2015. This request relates to the second report conducted in 2015.

I would at the very least like to know the latest traffic-light rating given to the HS2 project by the Major Projects Authority, and when this happened. I would also like a copy of this report.
Failing this, I wish to know the areas of concern and/or suggested actions which have been recommended.

I make this request under the EIRs. I feel the need to point this out, as despite rulings from the Information Commissioner on cases FER0467548 and FER0536325 submitted by Dr Paul Thornton, which established that MPA reports on HS2 contain environmental information as defined in the EIR.

I sincerely hope you will accept that MPA reports on HS2 are covered by the EIRs and reply accordingly, instead of employing the continual obfuscation I have come to expect when making these requests. I also do not expect a message claiming you do not 'own' the information as has happened in the past, as there is no concept of information “ownership” under the FOIA or the EIRs.

I am rather confused by your response to this request, or at least the part which states:

"We do not hold any reports on HS2 issued by the Major Projects Authority (MPA) in 2015."

This seems to be in direct contradiction to the response to a subsequent request which can be found at

Which states in relation to a request for information concerning all MPA reports on HS2 in 2015:

"HS2 Ltd does hold information in relation to this part of your request"

These two statements are completely incompatible. I demand an internal review.

Dear Mr Rukin,

 

Thank you for your email to HS2 Ltd and your request for an internal
review of our response (dated 19 January 2016, our ref: FOI15-1460) to
your request for the second MPA report conducted in 2015.

 

Firstly, I can confirm that our responses to your requests have been
consistent in that we do not hold any reports on HS2 issued by the
Infrastructure Projects Authority (“IPA”, formerly the Major Projects
Authority) in 2015. This is stated in our subsequent response (dated 15
March 2016, our ref: FOI16-1471) to part 6 of your request. I have
attached a copy of that response for ease of reference (please refer to
page 3 of the response).

 

As part of our complaints process which is provided on the last page of
our response, we ask that requests for internal reviews be made within two
calendar months of the date that the response is sent. As your request for
an internal review is outside of that time limit (which in this instance
was 19 March 2016), we will not be conducting an internal review of our
response issued on 19 January. However, I note that you have also
requested an internal review for your further request for information on
the IPA review and reports in 2015 (our ref FOI16-1471) and I can confirm
that this has been received within the time limit and we will carry out a
review on our subsequent response which was sent on 15 March. I will send
a separate acknowledgement.
