Thank you for your email received on 26 June 2013 asking for information
about responses to press reports or enquiries concerning pedestrian or
cyclist collisions involving bus services.
Your request has been considered under the requirements of the Freedom of
Information Act 2000 and our information access policy. I can confirm that
we do hold the information you require.
Any media enquiries regarding collisions between pedestrians or cyclists
and London Buses are managed by our Press Office. These incidents are
dealt with on a case by case basis. The aim of any media statement is to
provide timely and factual information about the incident; for example the
time, date, location, bus route, bus type and the name of the bus company
which operates the service.
We do not provide details of any injuries sustained by persons involved in
such incidents – this is the responsibility of the London Ambulance
Service or Metropolitan Police Service.
The attached protocol document is used as a guide for press officers
dealing with media enquiries relating to bus collisions.
Please note that in accordance with TfL’s obligations under the Data
Protection Act 1998 (DPA), personal data such as direct telephone numbers
and the names of non-TfL staff have been removed, as required by section
40(2) of the FOI Act. This is because disclosure of this personal data
would be a breach of the DPA, specifically the first principle of the DPA
which requires all processing of personal data to be fair and lawful. It
would not be fair to disclose this personal information when the
individuals have no expectation it would be disclosed and TfL has not
satisfied one of the conditions of Schedule 2 of the Data Protection Act
which would make the processing ‘fair’.
