1. Please provide the full text of contracts issued to Marstons Group and others involved in collection of Unpaid traffic Offences.

2. Please advise the charges these companies can levy if they have been agreed by Transport For London including any incremental increases allowable for inflation.

3. Where charges have been agreed please advise on what basis these charges have been made. In other words if a certain fee is agreed for a particular act E.G. writing a letter, carrying out a visit etc, please state how the fee was arrived at and if there are constituent components allowed (for example if a collection fee is intended to contain a debit card charge or not).

information about Parking Offences Recovery Agents.

 

Your request has been considered under the requirements of the Freedom of
Information Act 2000 and our information access policy. I can confirm that
we do hold the information you require.

 

1. Please provide the full text of contracts issued to Marstons Group and
others involved in collection of Unpaid traffic Offences.

 

Four bailiff companies are contracted to work on behalf of TfL to enforce
warrants for non payment of PCNs: Equita Ltd, Marston Group, JBW, and TASK
Enforcement. Please see attached for a copy of one of the contracts, which
is identical for all companies.

 

2. Please advise the charges these companies can levy if they have been
agreed by Transport for London including any incremental increases
allowable for inflation.

 

The fees bailiffs may charge are set down in legislation, namely The
Enforcement of Road Traffic Debts (Certificated Bailiffs) Regulations 1993
(amended by The Enforcement of Road Traffic Debts (Certificated Bailiffs)
(Amendment) Regulations 2003). TfL’s contract with the bailiff companies
it uses to recover unpaid PCNs contains guidance on fees, which uses the
legislation for its basis. Please see Annex C of Schedule 13 of the
contract for TfL’s fee guidance.

 

3. Where charges have been agreed please advise on what basis these
charges have been made. In other words if a certain fee is agreed for a
particular act E.G. writing a letter, carrying out a visit etc, please
state how the fee was arrived at and if there are constituent components
allowed (for example if a collection fee is intended to contain a debit
card charge or not).

 

For certain activities, such as preparing and sending a letter or
attending to levy, the fee chargeable is prescribed in the legislation.
For other activities, such as attending to remove goods, the bailiff may
charge “reasonable costs and charges”. TfL would consider it reasonable to
charge for covering the cost of processing a debit card payment.
