Tesco trading agreement / contract

Response to this request is long overdue. By law, under all circumstances, Inverclyde Council should have responded by now (details). You can complain by requesting an internal review.

Dear Inverclyde Council,

Can you provide me with any information that you think falls within this request?

I am looking for all information held about the process in which a supermarket has to approach the local authority to open and trade in the Greenock area.

A copy of their contract/application/license and so on - that enables them to trade in the Greenock area.

What conditions/standards they need to meet to keep their contract/application/license and so on.

What informal/formal processes are open to me as a local resident of Greenock to complain to the Inverclyde Council about Tesco's negligence to the customers in relation to dangerous driving in their car park and anti-social behaviour within their car park and any guidance that I would need to be aware of.

What processes are available to me to request that Inverclyde Council can request Tesco to introduce measures to keep the car park safe from people being knocked down and safe from anti-social behaviour and any guidance that I would need to be aware of.

What processes are available to me to request that Inverclyde Council can request Tesco to introduce measures to keep the car park safe from people being knocked down and safe from anti-social behaviour - specifically asking Tesco to introduce a barrier for people coming in and leaving the car park, CCTV that is not constantly broken and speed bumps introduced and any guidance that I would need to be aware of.

What local processes i can use to have the issue of anti-social behaviour lodged at public meetings for elected members/committees - and any guidance that I would need to be aware of.

I am looking for all information held about the process in which a supermarket has to approach the local authority to open and trade in the Greenock area. A copy of their contract/application/license and so on - that enables them to trade in the Greenock area.

Response: I attach a copy of the current Premises Licence (personal details redacted) and Mandatory Conditions pertaining thereto. Note at Point 10 within the mandatory conditions an annual fee is payable to maintain the licence on the premises. The original application form for the Premises Licence which was granted on 1 September 2009 is not held electronically. I will look for this when in the office tomorrow and scan it to you. They also have a late hours catering licence to permit them to trade 24 hrs, which is also attached.

Response: Any complaints of antisocial behaviour can be logged by the Antisocial Investigations Team on 01475 714204 or at [email address] This is to report ongoing issues and speak with Investigators. It is not a line if you need someone to attend immediately. For immediate assistance to witness antisocial behaviour the Community Wardens can be called on 0800 01 317 01. They are available from 1240hrs to 2330hrs. For ASB the legislation we use is Antisocial Behaviour (Scotland) Act 2004. This act allows Police Scotland to take action against driver and vehicle which can result in vehicles ultimately being seized.

This explains what is and what is not a complaint as well as practical guidance for using the complaint procedure. This procedure can only be used to complain about matters that the Council has authority over and offers or provides a service to the public.

Request: This land is private land and not a matter than the Council has authority over please see the guidance provided on dealing with Anti-Social Behaviour Service.

Response : From Members' Services, if a resident wishes to complain, he/she can contact their Ward Councillor by e-mail , telephone or by letter. Contact details for each Elected Member can be found on the Council's website at https://www.inverclyde.gov.uk/meetings/c... .

There is also a mechanism to raise matter of concern via the Petitions Committee. The Petitions Committee enhances community involvement and awareness of local government issues within Inverclyde. It affords Inverclyde's citizens, local businesses and organisations an opportunity to become involved, raise matters of concern direct and participate in informed debates via this direct route of engagement in the policy development process of the Council.
