I write in connection with your request for information dated the
29/10/09 which was received by Lancashire Constabulary on the 30/10/09.
I note you seek access to the following information:
* I would like to know how many arrests you have made under section 44
of the Terrorism Act 2000. I also want to know how many of these arrests
were students.
Your request will now be considered in accordance with the Freedom of
Information Act 2000, known hereafter as 'the Act'. You should receive a
response within the statutory timescale of 20 working days as defined by
the Act, subject to the information not being exempt or containing a
reference to a third party. In some circumstances Lancashire
Constabulary may be unable to achieve this deadline. If this is likely,
you will be informed and given a revised time-scale at the earliest
opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed
and the 20 working day timescale will be suspended until we receive
payment from you. If you choose not to make payment then your request
will remain unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer you query in the fullest
possible way. Again, you will be informed if this is the case.

My FOI request is now overdue. By law I should have received a response by 26.11.09. please advise on how much longer I will have to wait. to clarify i would like details of all uses of S44 Terrorism Act 2000, indicating if any are students.

Your request was received by Lancashire Constabulary on 30/10/2009,
making the due date for our response 27/11/2009, which I appreciate we
have now passed by one working day.
A response to your request has been prepared, but queries of this nature
have to be signed off by our Assistant Chief Constable who is
responsible for matters relating to Counter Terrorism and Covert
Policing. The response was forwarded to him for his approval on
26/11/2009, and he was made aware of the deadline for responding to your
query. Unfortunately, I have not yet received a response from the ACC
regarding this matter. As soon as he clears the response I will ensure
it is sent out to you, and I would imagine that this would be within the
next few days at the very latest.
Please accept my apologies for the delay, I do hope this will not cause
you too much inconvenience.

Please find attached our response to your request under the Freedom of
Information act, our ref 2126/09.
Once again, please accept my apologies for the delay in providing this
information, unfortunately requests for information relating to counter
terrorism measures have to be approved by Assistant Chief Constable Cooke
prior to release, and as previously explained it has been this approval we
have been waiting for.

Dear Hopkinson, Bryony,
Since reviewing the information you provided on 10.12.2009,I believe my request has been misunderstood.
Contrary to your claim that "This could reveal patterns or perceived patterns in the way this legislation is being used", I do not wish to know any details of arrests made under S44, only a total figure and a year or month when the arrest was made.
I do not wish to know where or why arrests were made, simply how many and, if and where possible, if any of these were students.
I do not believe that a ball park figure "would undermine the prevention or detection of crime".
Your case in favour of disclosure fails to address my rights as local resident to know if this legislation has been used for crime prevention purposes in my area. I feel this is particularly relevant in light of media scrutiny that S44 is misused.
