Thank you for contacting the Canal & River Trust with your request for
information.

 

You requested the following information:

 

The PowerPoint document with the title Term_time_cruising_example_GU and
the file name Term_time_cruising_example_GU.PPTX. This document was
emailed to a boater by Simon Cadek on 30th August 2019

 

I can confirm that the Trust does hold the information requested however
it is exempt from disclosure to you under Section 40(2) of the Freedom of
Information Act. This exemption from disclosure applies to third party
personal data, where disclosure would breach any of the Data Protection
Principles.

 

Personal Information is defined under GDPR and information relating to a
living individual from which that individual can be identified either
directly or indirectly, in combination with other information. In this
case the information requested identifies the school that the boaters
children attend and also identifies their general location.  I believe
that this information in combination with other information would enable a
determined individual to identify the particular boater and their children
and then disclose where the family are likely to be located at any given
time. As there is no legal basis under which the disclosure of this
information to you would be lawful Section 40(2) of the Freedom of
Information Act applies to this information.

 

This exemption applies to the information requested as we believe that a
living individual could be identified from the information. The disclosure
of the information requested to anyone other than the boater concerned
would breach the first data protection principle as it would be unfair to
the individual and unlawful to disclose their personal information to the
world in response to a Freedom of Information request.  It would be
unlawful to disclose the data as I can identify no legal basis which would
permit disclosure of the information to anyone else.

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of this email and should be sent
