Tenders for Recruitment of Principal and Vice Principal
Dear Ayrshire College,
Under FOISA, please supply me with the following information in electronic format:
The contract award notice listed on the Public Contracts Scotland website states that the recruitment tender for both Vice Principal and Principal of Ayrshire College was split into two lots; Lot 1 was a tender for Principal and Lot 2 was a tender for Vice Principal.
1. Can you please advise the names of each of the seven bidders along with the amounts they bid for lots 1 and 2 separately?
2. Criteria on which bid was awarded and who made the final decision of award?
3. Successful bidder - are you aware of any conflicts of interests between any member of the Board of Management (including Chairman) and any Directors (with significant control or otherwise) of Aspen People? If so, please advise.
4. Total amount paid/still to be paid to Aspen People for the services provided for Lots 1 and 2 of this tender.
Please provide this information within the 20 working day timescale and acknowledge receipt of this request.

I am writing to request an internal review of Ayrshire College's handling of my FOI request 'Tenders for Recruitment of Principal and Vice Principal'.
I note that you have refused to disclose the amounts bid by each tenderer and the total amount paid/still to be paid to Aspen People under section 33(1)(b) of the Freedom of Information (Scotland) Act 2002 (FOISA). As you will also be aware, all of the exemptions in section 33 are subject to the public interest test. This means that, even if the exemption applies, the information must be disclosed unless the public interest in withholding it outweighs the public interest in disclosing the information. As Ayrshire College were previously aware of the relationship between the Chairman of the Board of Management and a Director of Aspen People before awarding the tender, I feel that it is especially important and in the public interest to allow all previously requested information to be released. Releasing this information will allow Ayrshire College to show that they are acting upon their values listed on pages 5 and 8 of their Strategic Plan 2017-20 to be ‘open and honest’ and a ‘high-performing, sustainable institution with modern, transparent and accountable governance arrangements’. Given the most recent article in the local press regarding the current financial status of the College, this will also show that they are in fact providing the best value of the public funding awarded to them.
I will also be grateful if you can attach a scanned copy of the declaration of interest signed by the Chairman along with a copy of the appropriate minutes.

We refer to your email sent on 30 November 2018 (from Joan Winters <[FOI #529771 email]>) requesting a review of how the College has dealt with your request for information in relation to tenders for the recent recruitment exercise for Principal and Vice Principal. As you may be aware, FOISA provides that a valid request must provide the true name of the applicant making the request. Knowing the true name of the applicant can also be important when considering whether certain exemptions may or may not apply, for example, when assessing whether the exemptions in section 38 of FOISA relating to personal data are to be applied.
Under our duty to give advice and assistance to you, please could you confirm the details of your true identity for the purpose of your FOISA request, which is now at review stage? Section 8 of FOISA provides that the College is under no obligation to comply with an information request if it is invalid.
In terms of the third party personal data falling within the scope of your request that has currently been withheld from you, we would be grateful if could you confirm what you consider to be your legitimate interests in receiving the requested information and having it disclosed into the public domain under FOISA? This will assist us in reviewing how we have dealt with your information request in so far as you are requesting third party personal data whose disclosure into the public domain under FOISA will impact on the rights, freedoms and legitimate interests of the individuals to whom that personal data relates.
Please provide confirmation of your true identity and details of your interests in having third party personal data disclosed into the public domain under FOISA by 17 December 2018, by return of email.
