Response

 

 1. The Council is uncertain as to which specific portal the question
relates, however in general the Council does not use such a portal for
LD care tendering purposes. Ordinarily, up to three Providers are
short-listed and invited to Tender on the basis of the following
criteria; Ability to meet care/support needs; Service User / Family
preference; Cost; Geography; track record and experience; CQC/ LCC
quality status.

 

 2. Under the Mental Capacity Act this is a difficult question to answer.
People have different levels of capacity in response to the decisions
which they are capable, or not capable of making.

which they are capable, or not capable of making. It would be fair to
say that all 29 people placed have a lack of capacity in relation to
the ability to make all of their own decisions. Where this is the
case, the Council ensures that they are appropriately supported to do
so.

provided.
