Thank you for your email received by us on 25 April 2014 asking for a copy
of any tender relating to parking enforcement.

 

Your request has been considered in accordance with the requirements of
the Freedom of Information (FOI) Act and our information access policy.

 

Unfortunately, to provide the information you have requested would exceed
the ‘appropriate limit’ of £450 set by the Freedom of Information
(Appropriate Limit and Fees) Regulations 2004.

 

Under section 12 of the FOI Act, we are not obliged to comply with a
request if we estimate that the cost of determining whether we hold the
information, locating and retrieving it and extracting it from other
information would exceed the appropriate limit. This is calculated at £25
per hour for every hour spent on the activities described. Your request
for ‘any tender relating to parking enforcement’ would require us to look
through several years of records to determine what information we hold and
then retrieve any relevant data. Tender exercises generally attract
numerous submissions from several different bidders and since no time
period has been specified, would mean we’d need to look through years of
procurement data, including archived material, to determine how much
information we hold is covered by your request.

 

To help bring the cost of responding to your request within the £450
limit, you may wish to consider narrowing its scope so that we can more
easily locate, retrieve and extract the information you are seeking. If
you want to refine your request or make a Freedom of Information Act
request in future, please bear in mind that the Freedom of Information Act
allows you to request recorded information held by us. You should identify
the information that you want as clearly and concisely as you can,
specifying the types of document that you are looking for. You might also
consider limiting your request, for example, by stating the specific
periods of time that you would like the tender submissions to cover, which
specific areas of parking enforcement you’re interested in, whether you
are referring to the most recent winning tender submissions or even if you
just require the name of the companies involved in parking enforcement.

 

Although your request can take the form of a question, rather than a
request for specific documents, we do not have to answer your question if
it would require the creation of new information or the provision of a
judgement, explanation, advice or opinion that was not already recorded at
the time of your request.

 

Please note that we will not be taking further action until we receive
your revised request.

Dear FOI,
My main concern is of course only the current successful contender(s) that I believe to have been NSL. Any bailiff work would have been further tendered by NSL on behalf of TfL. So my question remains as is.
So just to clarify I need the tender that enabled NSL to do the statutory civil parking control work on behalf of TfL and any tenders NSL have done on behalf of TfL.
I am expecting my full reply within the next day or two.
This reply was already 1) late over the statutory limit and 2) could have been given at day one.
Section 10(1) requires a public authority to comply with section 1(1) promptly and within 20 working days. The basic, primary obligation is to reply promptly; the 20 working day time limit is only a “long stop” provision.

If section 12 of the FOI Act is again to be relied upon I will need a fuller breakdown how one comes to this figure. In fact one may even argue that TfL may even be a legislative body carrying out government work.
