FREEDOM OF INFORMATION REQUEST REF: 2017-0811

 

I am responding to your request under the Freedom of Information Act 2000,
which we received on 19 June 2017, for information held by the Council.
Your request is as follows:

 

Please forward the tenancy list and electral register for all residents of
Grenfell Tower as soon as possible.

 

I confirm that we hold the information requested.

 

Under section 40(2) of the Freedom of Information Act we are permitted to
withhold information which, if disclosed, would breach any of the
Principles contained in the Data Protection Act. The tenancy list contains
the names of individuals so is personal information. Release of the
information would breach Principle 1 of the Data Protection Act (fair and
lawful processing). It would be unfair to disclose this information
because residents of Grenfell Tower have a reasonable expectation that
this information would not be released in response to a FOI Act request.
If disclosure led to identification then this would be an unwarranted
intrusion of privacy.

 

The tenancy list will contain information on those that passed away in the
fire, this information is exemption under section 41 of the FOI Act.
Tenancy information is provided to KCTMO in confidence and the duty of
confidence continues to apply after death. Although section 41 is an
absolute exemption in terms of the FOI Act, the duty of confidence is
still subject to the common law public interest test and therefore we have
given consideration as whether there is an overriding public interest in
disclosing the information. It is our belief that there is no overriding
public interest in disclosing the information as tenants provided the
information for housing purposes in the knowledge that it will be treated
confidentially, and will not be used for further purposes or released into
the public domain.

 

Under section 21 of the FOI Act, a public authority can refuse to provide
information that is reasonably available elsewhere. The electoral register
is a public document and can be viewed under supervision:
