National Requests, Environment Agency

Dear Jackson,

RE: Request for information under the Freedom of Information Act 2000
(FOIA)/ Environmental Information Regulations 2004 (EIR)

Thank you for your request dated 26 January 2023 with the subject: Freedom
of Information request - Temporary and Permanent Recruitment Information
Request

We respond to requests for information that we hold under the Freedom of
Information Act 2000 (FOIA) and the associated Environmental Information
Regulations 2004 (EIR).

Please find our response against each point of your request below:

1. Has the EA organisation used agencies to recruit temporary/contractor
staff?  Yes

1a.   If so please confirm the total agency spend on temporary/contractor
staff?

The information requested is not held centrally and will incur a
disproportionate cost to collate.

1b.   Please provide a breakdown of your answer to question 1a, splitting
the spend by job title/specialism to this level

The information requested is not held centrally and will incur a
disproportionate cost to collate.

2. Has the organisation used agencies to recruit permanent staff?

Yes

2a. If so please confirm the total agency spend on permanent staff?

The information requested is not held centrally and will incur a
disproportionate cost to collate.

2b.   Please provide a breakdown of your answer to question 2a, splitting
the spend by job title/specialism

The information requested is not held centrally and will incur a
disproportionate cost to collate.

3. The contact name of the person responsible for dealing with permanent
recruitment

As recruitment is not carried out centrally, there is no one person
responsible for permanent recruitment. It is managed within each business
area as and when the need arises, using agreed processes. We are unable to
provide this level of detail due to the disproportionate cost to collate.

4. The contact name of the person responsible for dealing with
temporary/contractor recruitment?

As recruitment is not carried out centrally, there is no one person
responsible for dealing with temporary/contractor recruitment. It is
managed within each business area as and when the need arises, using an
agreed framework. We are unable to provide this level of detail due to the
disproportionate cost to collate.

As a public body under FOI/EIR, we must provide reasons for this refusal.
We also share how we have considered the Public Interest for refusal and
disclosure. You can find details in the appendix.

If you are not satisfied you can contact us within 2 calendar months to
ask for our decision to be reviewed. We shall review our response to your
request and give you our decision in writing within 40 working days.

If you are not satisfied following this, you can then make an appeal to
the Information Commissioner Office (ICO), the statutory regulator for
EIR/FOI. The address is: ICO, Wycliffe House, Water Lane, Wilmslow,
Cheshire. SK9 5AF.  Tel: 0303 123 1113 (local rate) or 01625 545 745

Appendix

The exceptions that apply to the withheld information are:

Section 12 where the authority estimates that the cost of complying with
the request would exceed the appropriate limit.

The Public Interest Test

We have weighed the public interest factors in favour of maintaining the
exceptions and find that they outweigh the public interest factors in
disclosing the information. In carrying out the public interest test we
have considered:

1. Factors in favour of releasing the information:

General presumption of openness. The Environment Agency would only
withhold information if it is sure that disclosure would cause substantial
harm. Here the harm is the time and resource it would take to collate
together the information from every potential source would impact on our
ability to carry out our core role.

General need to promote accountability and transparency.

Whether the information is already public. In this case it is not.

2. Factors in favour of withholding the information:

‘Strength’ (and number) of grounds in the legislation.  S12 and S40 are
both applicable.

Prejudicing the effective running of the Environment Agency or other
public bodies. To provide the information requested would require a great
deal of time and effort to develop a detailed list of the information and
therefore is manifestly unreasonable and would detract from our primary
task of protecting the environment.

As indicated, upon assessing the factors in the public interest test, we
have assessed that in relation to the information requested and in
relation to the cost limit exemption, we find that the factors in favour
of withholding information outweigh the public interest factors in
disclosing the information.
