I am at this stage conscious and wary of the ICO's advice to Public Authorities on "vexatious requester" and concerned that an approach may be taken and adopted by you to unjustly classify me as such. Therefore, in the interest of cordiality and appeasement and to mitigate this, I have self-suspended and restricted myself from making any further FOI requests to you Bradford Council, until such times as this last FOI request, and all the other submitted FOI's have been fully completed and finalised before making any further FOI requests, thus preemptively avoiding becoming unjustly classified as "vexatious", given I believe I have always acted reasonably and responsibly and handled myself with self-restraint and decorum.

Dear Mr Hussain,

Following the Information Commissioners recent investigation, the Councils
response is set out below in relation to your request for information
under the Freedom of Information (FOI) Act asking to supply the following
information:

“Can you kindly supply me with the latest version the Telephone Directory
for Elected Members include the date of the latest version”

Following a deep dive search, the document in question has now been
located, please find a copy of the latest version 9 - 2023 attached for
your perusal.  Please note that the

redacted data is considered exempt from disclosure under Section 40(2) and
(3A) of the FOI Act as I am withholding the redacted information as it
contains wholly personal information relating to persons other than
yourself, the applicant.

Section 40(2) and (3A) of the FOI Act provides an absolute exemption where
disclosure of information would lead to a breach of the principles laid
down by the Data Protection Act 2018.  I consider the disclosure of the
unredacted information would constitute unfair processing in contravention
of the first data protection principle because those individuals whose
personal data has been withheld would not have had any reasonable
expectation that it would be disclosed in these circumstances. 

Therefore, this response acts as a refusal notice under Section 17(1) of
the Freedom of Information Act in accordance with Section 40(2) and (3A)
of the Act and this has been communicated to the ICO accordingly.

In accordance with the Freedom of Information Act, if you are not
satisfied with the reply to your request you can ask for an internal
review.  A request for an internal review must be submitted within 40
working days in writing to the Corporate Information Governance Team, City

Dear Freedom of Information,

Now that the matter is live under investigation with the ICO, being assigned to an investigator and I make this fact public knowledge, by my WDTK request annotation only but yesterday, you have miraculously now backtracked to provide the document in question, when on several previous occasions you were adamant that such a document does not exist.

In fact by 2023, eight previous versions excited, leading me to speculate that given version six was the copy I have of 2020, then you must have created version one, nine years ago in 2014.

Since 2014, a new updated version of this document has been created and distributed to the 90 elected councillors annually, yet you would now have me believe that you could not find this document in response to my FOI and following several internal reviews, and that only after following a "deep dive search", when knowing the matter is under a live investigation by the ICO, you have managed to locate this years recent version?

Really?

What credibility, reliability and confidence can members of the Public you serve now have in the manner in which you are handling and dealing with your obligation to the Freedom of Information (FoI) Act legislation when you are not able to respond to such a basic FOI Request?

I put it to you, City of Bradford Metropolitan District Council (CBMDC) that you are "WILLFULLY" negligent and neglectful to the duty of care you have under the laws you are obligated and governed under!

Dear Bradford City Council,

In your latest reply of 24th of August, you state the following :

"Following a deep dive search, the document in question has now been located, please find a copy of the latest version 9 - 2023 attached for your perusal.  Please note that the redacted data is considered exempt from disclosure under Section 40(2) and(3A) of the FOI Act as I am withholding the redacted information as it contains wholly personal information relating to persons other than yourself, the applicant."

Please can you help me understand and clarify your position? You have now presented to me a heavily redacted copy of version 9 of 2023, of this document in reply to my FOI request but as the title of this document states "Telephone Directory for Elected Members", then I must assume that an unredacted copy is made annually available to the 90 elected Councillors. I need you to help me understand what extra legal rights are afforded to my political representatives to have an unredacted copy of this document that are not equally afforded to me as a member of the public whom the "Elected Members" are meant to serve?

How can "we" the People vote to elect our political representatives who govern in our name, and are meant to operate in our best interest, who then once elected have more legal rights over the very people who have voted them into the position they hold as representatives of the People (Councillors).

My question is simply this, how is it that my political representative (Councillor) is entitled to an unredacted copy of this document but I as a rate-paying member of the Public whom you are all meant to serve and who has helped vote in the Councillor can not get an unredactect copy of this document ?
