We are writing to acknowledge your request for information received by the school at on 5th June 2015. You asked:

Are you aware of any of your 2014 teaching staff not holding adequate qualification for their teaching roles and indeed was this the reason for a mass exodus of teaching staff during September 2014 from your schools website?

You may or may not be aware but the Freedom of Information Act only covers documentation and information held in written or electronic form. A public authority (which includes schools) does not have to answer questions if this would mean creating new information (including opinion and judgments) that are not already recorded.

Whilst revealing specific individual qualifications may constitute personal data, in order to be as helpful as possible we can inform you that whilst on occasion we may have student teachers who are always accompanied by a mentor (who will be a teacher), all teachers appointed by Christ church primary school prior to 2014, during 2014, currently and to date are all fully qualified. We are not aware of an exodus of teaching staff.

We therefore require clarification under Section 1(3) of the Freedom of Information Act 2000 before proceeding with your request.

Can you please let us know which information or documents you are seeking?

Thank you for your timely response.

In September of 2014 at least three members of teaching staff were removed from the school website permanently (with other teachers being added). This information is held on public record, via the school website analytic data, which appeared publically on google.com. I have these records saved and will be glad to share them with you, along with specific dates, should you require them for clarification.

Following the departure of at least three members of your teaching staff in September of 2014, the headmistress of the school (presumably) resigned. Hence the advertised vacancy for her position, on public record. I have included an example of this publicly advertised vacancy below.

With the exception of the headmistress, were these members of staff students?

Due to the unusual nature of such a coordinated departure of teaching staff, further clarification of this issue is respectfully requested. As aforementioned, this information is recorded within the public domain. Therefore your judgement in which documents might best satisfy my request would be gladly received, alternatively please suggest if I should pursue further liaising with the Department Of Education.

Thank you for your email of 10^th June, the contents of which we note.

 

As previously explained, the Freedom of Information Act covers information
that exists and is held by the school. Additionally the Act is both
purpose and applicant blind which is to say that we treat all requests
fairly and in line with the legislation despite who the requester may be
or any justifications for the request we may receive.

 

As we explained in our previous email, all teachers appointed by Christ
church primary school prior to 2014, during 2014, currently and to date
are all fully qualified. We are neither aware of an exodus of teaching
staff in September 2014 nor has our head teacher resigned.  You have also
made reference to a web link job advert for a position at a Cheltenham
school in Gloucestershire.

Our school is situated in the London Borough of Camden so we are therefore
further perplexed by this request and require clarification under Section

records saved with regards to this “exodus” we would gladly receive them

Perhaps a document containing your current teaching staff might be quite helpful.

Understandably my request has altered somewhat, so of course any extension required to answer these

Firstly, we would like to thank you for bringing this to our attention. We have established that ‘aiHitdata’ is a bot site which automatically collects analytic data from some websites. We are neither responsible for their site nor do we routinely publish historical information. We will be raising this with our web developer to investigate options with regard to preventing the potentially intrusive collation of this data.

Whilst we confirm that we do hold the remainder of information requested, our response acts in part as a Refusal Notice under Section 17(1) of the Act.

Section 17(1) of the Freedom of Information Act 2000 requires us, when refusing to provide such information, to provide the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if it would not otherwise be apparent) why the exemption applies.

Although you refer to a period in the future with regard to school trustees, we assume you mean 2014 and can inform you that there has been no changes to the make-up of our trustees which comprises 1 x Vicar and 2 x Church Wardens. The head teacher is Katy Forsdyke

It is not uncommon for any staff to leave or transfer to other schools for all manner of personal reasons however with regard to your request about current and historic teaching staff names we consider that the exemption at Section 38 of the Freedom of Information Act 2000 applies.

Section 38: Health and Safety
Section 38 provides an exemption from disclosing information if such disclosure would endanger any individual (including the applicant, the supplier of the information or anyone else). The exemption does not necessarily deal with what are commonly thought of as health and safety matters such as the process of ascertaining the cause of an accident under health and safety legislation.

Section 38 also requires a public authority to consider whether the public interest in maintaining the exemption outweighs the public interest in its disclosure. In other words, to ascertain if whether the harm that would be likely to be caused to any individual by the disclosure would be greater than the public interest in the disclosure.

Most schools will have a list of teaching staff available on its website and indeed in normal circumstances it is a requirement of the Freedom of Information Act and in the public interest that schools routinely and proactively publish this information.

However the school has proactively withdrawn reference to names and roles from its website further to continued harassment brought about by unfounded accusatory comments posted into the public domain.

Whilst the comments have been determined as “utter nonsense” by the courts, there sadly remains a series of campaigning individuals who continue to pursue this course of action engaging Section 38(1).

Additionally as a response under the freedom of Information Act 2000 is a disclosure to the world at large and not just the requester, we are mindful that the absolute exemption at section 40(2) is also engaged with regard to third party personal data.

Whilst we accept that these are unusual circumstances, any individuals would not expect their details to be proactively published into the public domain following incidents which led to the court ruling and have not given their consent for us to do so.

As such we consider the health and safety of staff outweighs the public interest in making these names and roles publically available.

I am writing to request an internal review of Christ Church Primary School, Hampstead, London's handling of my FOI request 'Teaching Staff Qualifications'.

I feel my request was entirely reasonable for members of the public to be aware of. I have tried to be polite as possible and in no way do I feel is it reasonable to suggest the teaching staff's health and safety will be compromised by providing answers to publicly available data. I wish to know why the school's answers are contradictory within my Freedom Of Information request.
