By letter of 30 September 2009, The Secretary of State Ed Balls appointed Maurice Smith to enquire into the "promotion of racism in schools". Part of the review is aimed at determining whether members of the British National Party (BNP) should be allowed to work as teachers or in the wider school workforce.

Please provide the following information under the Freedom of Information Act 2000.

1. Has your authority ever found a member of the BNP or any other political Party guilty of a disciplinary offence related to their Party membership in the last three years? If so please give information as to when and how many.
2. Has any parent complained to you regarding the Party membership of any employee or the expression of political views within School classrooms under your authority during the last three years?
3. What safeguards do you currently have in place to prevent members of any political Party promoting their views within Schools?

Further to your request for information about `promoting racism in

The council does not held any records of instances of the above in the
last three years.

3. What safeguards do you currently have in place to prevent members of
any political Party promoting their views within Schools?

I have been advised that the Governing Body of each school determines
it's own policies and school posts are not classed as `politically
restricted' posts. However a new code of conduct for teachers came into
effect in September 2009 an extract of the code reads:

The Code does not seek to set new standards for teachers' private
behaviour. However, it does reiterate the well established principle,
present in the previous version of the Code and the codes of other
professional bodies, that some behaviours outside the workplace have the
potential to impact upon the credibility of the individual to undertake
their role and, more widely, to damage the reputation of the profession.
Employers will recognise this principle in their own context and that
certain behaviour by employees, which may be either unlawful or lawful,
within or beyond the workplace, could undermine the position of the
individual and the employer.

Most of the information that we provide in response to Freedom of
Information Act 2000 and Environmental Information Regulations 2004
requests will be subject to copyright protection. In most cases the
copyright will be owned by Walsall Council. The copyright in respect of
other information may be owned by another person or organisation, as
indicated.
