Response to this request is long overdue. By law, under all circumstances, Gwynedd Council should have responded by now (details). You can complain by requesting an internal review.

Thank you for your recent request. Please see below for the information requested:

Gwynedd Council would refuse to disclose personal data by engaging the exemption for third party data under Section 40(2) of the Freedom of Information Act 2000, which is the exemption that applies to information being the personal data of someone other than the requester.
Disclosure of such information to a member of the public, would contravene the data protection principles, as such information is not available in the public domain. The first data protection principle would be breached in that the processing of the data would not be fair.
The numbers of teachers referred to the Education workforce Council is extremely low. There is a risk that indivuduals could be identified. We have a duty to refer to the EWC, but it will be the Education Workforce Council's decision to bring a case against an individual teacher or not. Any teachers that the EWC have made a judgement against will be on their website: https://www.ewc.wales.
Further, the Council cannot identify any legitimate interest in disclosing an individual’s identity.

The disclosed information may contain copyright material, and notwithstanding Gwynedd Council’s disclosure the document may still be copyright protected. It is important for you to respect any copyright status that may attach to a particular document. Fair dealing provisions allow information to be used in certain ways without infringing copyright. This allows the contents to be debated publicly. Fair dealing allows disclosure to serve the public interest of increasing accountability and transparency. Of particular importance is the provision which allows the criticism, review or news reporting of copyright information.

Complaints

If you are unhappy with the way the Council has handled your request, you may ask for an internal review. Please contact me if you require an internal review of your case. An internal review will be conducted by the Monitoring Officer or Head of Service and we will aim to respond within 20 working days. However, if we are unable to complete the review by this date, we will advise you accordingly.

Dear Gwynedd Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Gwynedd Council's handling of my FOI request 'Teachers reported to the Education Workforce Council'.

After requesting this data from other councils, who also have low numbers, I have received the information.

Please review this decision, as I believe the exemption has been applied wrongly. Note that I am not requesting personal information.
