FOI, Derby City Council

Dear Sam Andrews,

Thank you for your request received 10/10/19 under the Freedom of
Information  Act 2000 (FOIA) for ‘Prevent Programme’

The Council is considering your request and although the Act says we
should disclose information, it also provides exemptions we can use to
withhold information in specific circumstances.

Some of these exemptions, referred to as ‘qualified exemptions’, are
subject to a public interest test.  This test is used to balance the
public interest in disclosure against the public interest in favour of
withholding the information.

In these circumstances the Act allows us to extend the response deadline
by 20 working days to consider the public interest test.

The qualified exemption(s) applied to your request.  This is because to
disclose the prevent programme information requested would/would likely
prejudice …

Section 40(2) Personal data third party

Section 24: National security

Section 31: Law enforcement

Section 38: Health and safety.

We have extended the 20 working day response period and will let you have
a full response by 5/12/19 or earlier if possible.

You can ask for our decision to be reviewed under the Council’s FOI
Complaints Procedure.  Please send your appeal reasons within 40 working
days to the …

Please note, the following applies, if the response includes council
officers (or other officers) names.

If you are a company that intends to use the names and contact details of
council officers (or other officers) provided for direct marketing, you
need to be registered with the Information Commissioner to process
personal data for this purpose. You must also check that the individual
(whom you wish to contact for direct marketing purposes) is not registered
with one of the Preference Services to prevent Direct Marketing. If they
are you must adhere to this preference. You must also ensure you comply
with the Privacy Electronic and Communications Regulations (PECR). For
more information follow this Link [6]www.ico.org.uk

For the avoidance of doubt the provision of council (and other) officer
names and contact details under FOI does not give consent to receive
direct marketing via any media and expressly does not constitute a ‘soft
opt-in’ under PECR.
