Dear Swansea Council, in pursuance of a civil litigation for failure to pay a parking charge or fine imposed by your council, please identify the party litigant by name (man or woman) who is the land owner (of public property) claiming tort against the defendant as defined in CPR.

This is not a request for legal advice, it is a request for fact of law

I also remind you of your duties and obligations to the Nolan Principles.

Dear Environment FOI, your response does not meet the requirements of my request, as there is no man or woman called "City and County of Swansea" who can make a claim in a civil procedure. Mt request is very simple, I simply request the name of the man or woman as landowner who claims tort.

In response to your e-mail received today the City and County of Swansea Council is a body capable of owning land and commencing / defending legal proceedings much in the same way a private company is able to do so.

Dear Swansea Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Swansea Council's handling of my FOI request 'Swansea Council - Public Land Owner'.

Your response is factually incorrect. A council, being a corporation is regarded in civil law as a dead entity, therefore is incapable of owning anything.

The man/woman making the complaint, the signature on the parking ticket must be the complainant. Throw it back in his/her court.

It is the land owner in this case who makes a civil claim. A complaint refers to criminal matter and parking is not and never can be a crime. Thank you for your interest.

Dear Ahern, Leanne, your review is rejected as it does not address my request:

I requested the name of the man or woman. If you have no comprehension of Civil Law and its procedures you are certainly not qualified to adjudicate in the matter of a review.

Andrew Taylor is just a yes man, do anything he is told. Write a letter to Patrick Arran head of legal at Swansea Council. Being that it is a legal question get him to confirm in writing.
