I am writing regarding your request for information received on 23
November 2020. In that request, you asked us for the following:

 

 1. All information in the last year between Highways England, DfT and
contractors about the suspension of smart motorway construction and
potential termination of the projects.
 2. What penalties are there for the suspension or termination of the
contracts?  
 3. All information in the last year between Highways England, DfT and
contractors about the safety issues associated with smart motorway
construction. 

 

Whilst we are able to provide a response to Q1 and Q2 above, we have
estimated that the cost of compiling your request for Q3 will exceed £450.
Section 12 of the Act does not oblige us to comply with requests if they
exceed this limit.

 

The request for ‘all information’ is too broad, so it would be helpful if
you could narrow down the information range and advise what type of
information would be most useful to you – e.g emails or correspondence or
policy documents etc.  

 

I appreciate that we are late coming back to you to ask you to reduce the
scope of your request, my sincere apologies for this.

 

In the interim I have provided a link below to the Smart Motorway
Stocktake Report and Action Plan below which you may find informative.

We have estimated that the cost of compiling your request will still
exceed £450. Section 12 of the Act does not oblige us to comply with

For us to be able to provide information on this request I would ask that
you narrow down your request to two schemes of your choice and we could
then look at providing 6 months of information for each of the schemes. To
assist with this request I have attached a map of current and completed
