Dear Mr Davies,
Thank you for your request for information about Suspension of Cardiff
Park Run, which we received on 20^th September 2011, and which falls under
the Environmental Information Regulations 2004.
We are considering your request under the terms of the Environmental
Information Regulations 2004. You should receive the information requested
within 20 working days. However under Regulation 7 we can extend the
timescale for a response if the information is exempt, we require
additional time to consider whether disclosure is in the public interest
or the information requested is complex and additional time is needed for
collation.
Cardiff Council’s policy is to carry out the spirit and requirements of
the Environmental Information Regulations 2004, in a manner which:
- recognizes the duty to inform as the essential principle underlying the
legislation;
- discloses to requesters the maximum information possible which is not
injurious to the public and private interests identified in the exemptions
in the regulations and does so in the most timely and consistent manner
given the nature and scope of the request;
- ensures that fees permitted under the regulations are kept to an
absolute minimum whilst safeguarding our position as a non-profit making
organisation
We will try to supply information in electronic format by email, but if
this is not possible we will let you know. If you have any special
requirements e.g. language, audio, large print, etc. please let us know.
The Regulations define a number of exceptions which may prevent the
release of information. If any exceptions apply to your information
request they will be considered prior to disclosure. If any of the
exemption categories do apply an explanation for non-disclosure will be
included in the Decision Notice response you will receive, included in
this notice will be your right to seek an internal review of our decision.
If the information you request contains reference to a third party then
they may be consulted prior to a decision being taken on whether or not to
release the information to you. We will keep you informed if this issue
arises.
In some circumstances a fee may be payable for the information you have
requested, we will inform you of the details if and when appropriate. In
these circumstances you will have to pay the fee before we process and
release the information. The 20 working day time limit for responses will
not start until we receive your payment.

Thank you very much for your response to my enquiry. Your response to my first question was, unfortunately, incomplete.
I asked for 'details of the "H&S reasons" cited in Ms. Sheppard's email, including any risk assessments' and while your response does state that Cardiff Council does not perform risk assessments, it fails to give details of evaluation of the "H&S reasons" quoted.
As it was Cardiff Council who cited "H&S reasons" some kind of evaluation must have been performed and it is this that I am looking for.

I refer to you email dated 25th October 2010 to Alyson White(Parks and
Sports) raising concerns that you were not happy with the response that
you received to your FOI request regarding Cardiff Park Run.
As the area responsible for ensuring that the Council complies with its
statutory duties under the Freedom of Information Act/Environmental
Information Regulations I have carried out an internal review into the
handling of your request.
Following an investigation into this matter it is clear that the Council
did not answer your request in accordance with the Act.
Your request asked for details of the "H&S reasons" cited in Ms.
Sheppard's email, including any risk assessments'
Under Section 1 (a) of the Freedom of Information Act/ Regulation 5 (1)
of the Environmental Information Regulations a public authority has the
duty to confirm if it holds recorded information within the scope of a
request and under Section 1 (b) FOIA, Regulation 5 (2) EIR to provide
the information to an applicant unless there is a valid reason for
refusing.
Following my investigation it is apparent that additional information is
held which falls within the scope of your request and as a result I have
instructed the Parks department to answer your request again in full
within the next 5 working days.
Please accept my sincere apologises on behalf of the Council for our
failure to accurately respond to your request. The Council is currently
reviewing and changing its processes to ensure that all requests in
future are answered in accordance with our statutory requirements under
the Act.

1. Details of the "H&S reasons" cited in Ms. Sheppard's email,

Response:
1. A meeting involving Cardiff Council Parks & Sport
representatives and Cardiff Park Run Event Organisers was held at Wedal
Road on 21st September 2011. Following this meeting the Event Organisers
supplied an updated course map and risk assessment (see attached).
A site meeting was held on the 24th September and a number of observations
were made. A further meeting was held at Wedal Road on 11th October where
the recommendations of the site visit were discussed with Cardiff Park Run
Organisers and actions were agreed. A further meeting will be scheduled to
review the Event Organisers progress against agreed actions.
2. Details of complaints received regarding the event, redacting
any Personally Identifiable Information if necessary. I am
particularly interested in any correspondence from companies
in
this respect.

2. Three complaints were received Monday September 19^th
from members of the public. All the complaints were based on the large
groups of runners taking part in a run on the Taff Trail. The complaints
were that they could not continue along the Taff Trail because the runners
were completely blocking the path. They all stated they received abuse
from the runners when they requested to be let through.

Dear Alyson,
Thank you for responding to my request for clarification.
I understand this to read that the risk assessment that you have provided me was supplied to the Council by the Event Organisers on September 21st.
It would therefore appear from your response that on the date of 19th September, when Bernadette Sheppard contacted the [email address] address quoting:
"you will no longer be able to use the Taff Trail as part of the route. This is because of H&S reasons",
the Council had not actually identified any such "H&S reasons", or performed any cursory risk assessment, at all.
Could you please confirm if this is the case and, if not, supply the information that the Council used to arrive at the conclusion presented by Ms Sheppard?
