Dear Martin Williams,
Thank you for your Freedom of Information (FoI) request received on 12th October. You
wrote:
“On 16/03/2020, the Upper Tribunal decided that a refugee having their first child in the
UK was entitled to a sure start maternity grant despite having another child aged under
16 in their household who was born before the refugee fled to the UK.
The judgment is SK and LL v Secretary of State for Work and Pensions [2020] UKUT
145 (AAC)and is available here: https://www.gov.uk/administrative-appeals-tribunal-

Please release any guidance issued to those administering or deciding claims for sure
start maternity grants on applying the judgment in this case.”
