Dear Small Heath Leadership Academy,

I am writing to you to ask under the FOI if you can explain:

1. How those whose job it is to help those with SEND needs including those who may be the Head of SEND (or whatever the equivalent titles) are selected?
2. How much both the staff members and the head are paid?
3. How much of the money which is provided by the child having additional funding goes into the staff's wages?
4. How often are those who are involved in supporting those with SEND are regular/ agency workers?
5. How often are those involving supporting children with SEND are reviewed? And how is it determined they are supporting the child in the best way possible?

Yours faithfully,

Jamshed Khan

Simon Thomson,

Dear Mr Khan,

Freedom of Information Act 2000 – Information Request

Thank you for your request for information, which Eden Boys’ School,
Birmingham , Eden Boys’ Leadership Academy, Birmingham East, and Small
Heath Leadership Academy, which the schools received on Sunday 23rd
October 2022 requesting information regarding SEN provision.  Please note
that the answers that we are providing relate to all three schools.

The answers to the questions that you asked as part of your request are as
follows:

1.      How those whose job it is to help those with SEND needs including
those who may be the Head of SEND (or whatever the equivalent titles) are
selected?  In line with Section 21 of the Freedom of Information Act 2000
we are declining to provide an answer to this question as the information
is already reasonably accessible.  The information is available to Star
Academies’ SEND Information Report Policy and Guidance (Eden Boys’ School
Birmingham have it listed as the Special Educational Needs Policy), which
can be accessed by clicking on the following links:

◦ Small Heath Leadership Academy: [1]Policies & Publications | Small
Heath Leadership Academy
◦ Eden Boys’ School, Birmingham: [2]Policies and Publications | Eden
Boys' School, Birmingham | Part of Star Academies
(edenboysbirmingham.com)
◦ Eden Boys’ Leadership Academy, Birmingham East: [3]Policies &
Publications | Eden Boys’ Leadership Academy
(edenboysbirminghameast.com)

2. How much both the staff members and the head are paid?  In line with
Section 40(2) of the Freedom of Information Act 2000 we are not providing
this information, as we believe to do so would breach principle one of the
UK General Data Protection Regulation (Lawfulness, Fairness, and
Transparency).  We do not believe it would be fair to members of staff,
including the Principal, to supply this information and we do not feel
that it would be lawful to share this information.
3. How much of the money which is provided by the child having additional
funding goes into the staff's wages?  We do not hold this as specific
information.  As per the Code of Practice, 2015 provision and funding for
this depends on the specific needs of the child and the statutory
provision as detailed in Section F of their Education, Health, and Care
Plan.  This is sometimes used to employ a teaching assistant but not
always.
4. How often are those who are involved in supporting those with SEND are
regular/ agency workers?   We don’t hold this as specific information.
However, it could depend on needs of pupils and the cohort.  It is also
dependent on staff absence and other available resource.

5. How often are those involving supporting children with SEND are
reviewed? And how is it determined they are supporting the child in the
best way possible?  It is completed through the annual appraisal system
and further reviews are conducted as and when required.

If you are unhappy with the service that you have received in relation to
your request and wish to request a review of the decision, you should
write to:  Freedom of Information, Star Academies, Shadsworth Road,
Blackburn, BB1 2HT or email [4][email address].

If you are not content with the outcome of your review, you may apply
directly to the Information Commissioner’s Office (ICO) for a decision.
Generally, the ICO cannot make a decision unless you have exhausted Star
Academies’ procedure.  The information Commissioner can be contacted at:
Telephone 0303 123 1113 or via [5]www.ico.gov.uk.

Yours sincerely,
