Request under the Freedom of Information (Scotland) Act 2002
I refer to your correspondence dated 8 November 2022 requesting
information in relation to supporting gender reassignment: proposal to
undergo gender reassignment, even if he or she takes no further steps.
The Council is treating your request as a request under the Freedom of
Information (Scotland) Act 2002 and can respond as follows:
As you are looking for a collated figure of the number of pupils that have
received gender reassignment recognition that the school have supported
and that he or she has proposed to undergo gender reassignment, even if he
or she takes no further steps or decides to stop later on, I hereby give
you notice in terms of Section 17 of the Freedom of (Information) Scotland
Act 2002, that this information is not held. We do not centrally record
this information.
Further, any discussions with pupils regarding gender reassignment would
be recorded at individual level within pupil files/pastoral notes. A
Scottish public authority is not obliged to comply with a request for
information if the authority estimates that the cost of complying with the
request would exceed such amount as may be prescribed in regulations made
by Scottish Ministers, such amount currently being £600. In order to
collate figures as requested by you, a manual trawl through all pupil
files would be required. There are currently 16149 pupils within the East
Ayrshire area. As such, we are unable to provide this information.
However, regarding gender reassignment recognition generally, as a Local
Authority and Education Service, we approach gender change in a very
sensitive manner with the wellbeing of the young person at the centre of
our processes. Schools work with pupils and families to support young
people who are trans gendering and for those who are struggling with
parental support, we help them have discussions with parents in a
controlled and secure environment. Any pupil who approaches the school
seeking gender reassignment recognition will be listened to, supported and
recognised.
