Thank you for your information request dated 1^st March 2018. I can
confirm that we do hold some of the requested information. The request has
been considered under the Freedom of Information Act 2000. The response to
your request is as follows:

 

Commercially Sensitive Information

Part of this FOI falls under the exemption to disclosure under s. 43(2)
FOI Act (Commercial Interests). Disclosure of the information would, or
would be likely to, prejudice the commercial interests of any person. This
includes the Council or a third party.

 

Disclosure of the information would prejudice the Council’s ability to
compete to provide goods / services in a competitive market. I have
considered the public interest test – that the public are entitled to be
assured that the Local Authority are maximising their income to meet with
budgetary demands. However, this has to be weighed up against the risk of
competitors undercutting the Council and therefore the Council incurring
loss of income. Therefore, the test has been applied in favour of non-
disclosure.

East Midlands Framework. The Authority also uses 190 “spot “ providers.
