Supplementary employment on tier 2

Response to this request is long overdue. By law, under all circumstances, Home Office should have responded by now (details). You can complain by requesting an internal review.

Dear Home Office,

My question is about supplementary employment on tier 2 general visa.
Can a tier two general migrant take up a supplementary job for less than 20 hours in the same occupation code and title as they are sponsored for as a self employed? For example a barrister taking up a case of his own or a dentist doing locum work.
Or do they have to be employed for their supplementary work and paid through PAYE?

The policy guidance on tier two general doesn’t clarify on this and only states that a tier 2 migrant can take up a supplementary or voluntary work for less than 20 hours per week outside of the timings of their primary job in the same occupation category. It doesn’t clarify on whether this work can be taken up as self employed or not.
