requested the following information:

registers to include persons suffering from Personality Disorder?”
The Information Access team has now coordinated a response to your
request. This response can be read in conjunction with our response on
the linked request under reference CQC IAT 2223 0312.
CQC has considered your request in accordance with the Freedom of
Information Act 2000 (FOIA).
Our first obligation under the legislation is to confirm whether we do or
do not hold the requested information.
In accordance with section 1(1) of FOIA we are able to confirm that CQC
does not hold recorded information in relation to this matter.
A review of the Care Programme approach in 1999 announced the abolition of
Supervision Registers and the requirement to maintain them was removed.
People with diagnosed personality disorders who met the general criteria
for the Supervision Register would have been eligible. You can find more

The Department of Health has provided the below document that confirms that mental illness includes psychopathy and personality disorder, can you explain why you have not confirmed this also?

Mental illness in this context includes people with a diagnosed personality disorder including psychopathic disorders who are receiving treatment form specialist psychiatric services.

Thank you for your email.
We understand that there was no direct replacement to Supervision Registers. In theory the Care Programme Approach (CPA) provided structured care for anyone identified as needing mental health services. The CPA itself is currently being re-shaped.
In relation to your point regarding Health Service Guideline HSG(94)5, your Freedom of Information request only asked whether there was a requirement for supervision registers to include those suffering from personality disorder. There was no reference made to psychopathy.

The register has been replaced with Community Treatment Order (CTO), and the register was intended to include all who experience psychopathy/psychopathic disorder/personality disorder, and I am asking that you please clarify the facts.

It is recorded that it pertains to personality disorder and psychopathy, you are just being difficult rather than bothering to investigate the specifics of the inquiry. I ask that you go and look as I can direct you to where it does reference personality disorder and psychopathy, and if you read Eldergill's contribution then you would see that it is defined, and this would also be concluded within circulars of that time-period.

I have reviewed CQC's handling of your request under the Freedom of Information Act 2000 (FOIA) of 27 July 2022 (our ref: CQC IAT 2223 0313). I apologise that this Internal Review response was slightly delayed.
You asked for the following information:
"Can you please confirm if there is a requirement for supervision registers to include persons suffering from Personality Disorder?"
CQC answered this request on 10 August 2022 to advise that CQC does not hold the requested information as Supervision Registers have been abolished.
I am satisfied that this was the correct response and met CQC's obligations under FOIA.
You responded on 10 August 2022 to ask "Do you know what took over from the Supervision Register?"
CQC responded to that request on 18 August 2022 to advise that there was no direct replacement to Supervision Registers and to provide some further advice.
You have also raised issues regarding the inclusion of personality disorder, including psychopathic disorder, within the definition of mental illness given by the Department of Health and Social Care (DHSC). On 10 August 2022 you asked why we had not also confirmed this within our original response. On 18 August we advised that we did not refer to this in our response because you had not asked about it in your request. I am satisfied that this was appropriate advice and assistance in relation to your request and that CQC's original response remains accurate and fully answered the scope of your request.
Your further email of 30 August 2022 does not contain a request for recorded information. I have reviewed the correspondence relating to this request and CQC has not made an assertion that the definition of mental health excludes personality disorder and psychopathy. As advised in our email of 30 August 2022, if you have further general enquiries regarding this matter they can be directed to our Enquiries team.
