Thank you for your request received on the 16 February 2023, in which you asked for the
following information from the Ministry of Justice (MoJ):
If possible, could you please clarify why in 2017/18, there were 0 cases that met the
section 133 test, but £100,000 was paid in compensation? Would this be
compensation for someone who made an application in a previous year?
Your request has been handled under the FOIA. I can confirm that the MoJ holds the
information that you have requested, and I have provided the information below.
The answer to your second question is ‘yes’. Those who met the statutory test for
compensation in any given year may have applied in a previous year. There is no correlation
between the number of people who met the statutory test in any given year and the amount
of compensation paid in that year. Because of the time it takes to process an application, an
individual who meets the statutory test may not receive compensation in the same year their
application is made.
