Thank you for your Freedom of Information request in which you asked:

" How many submissions to councillor.net did each individual WMBC councillor make in the 12 month period from January to December 2017?"

Please be advised that there were a total of 511 submissions by Councillors to Councillor Net in 2017.

We do not hold this information broken down by individual Councillors. We are unable to provide this without undertaking a manual exercise which is estimated to exceed the time limit prescribed by Section 12 of the Freedom of Information Act 2000. Under Section 12 of the Act, public authorities are not required to comply with a request for information if to do so would exceed the appropriate limit, currently set at 18.5 hours and as such the Council relies on section 12 (1) to refuse your request.

You have the right under Section 17 of the Freedom of Information Act 2000 to ask for an internal review of the refusal of the information requested. Please direct any request for an internal review to [Wirral Borough Council request email] and your request will be allocated to another officer for review.

If you are dissatisfied with the outcome of an internal review you also have the right to complain to the information Commissioner, who can be contacted at https://ico.org.uk/global/contact-us/

It is a little difficult to understand how breaking down 511 submissions could take more than 18.5 hours, but I am of course, happy to accept this and to offer to do this work myself, if you will supply the raw data - simply Councillor A made a request, Councillor F made a request and so on - or more complex information if this is how you hold it.

By law, you should have responded promptly. It is now over a month since that request was made. An immediate response is now due.

However, you delayed doing so for nearly six weeks; and you have now reversed your first decision (that providing the information as requested would take so long that it could legally be refused) without explanation.

- the (illegal) delay

The purpose of the internal review process, where a requester is dissatisfied with the outcome of a request, is to enable an impartial and unbiased review of the available evidence and where required, to make a fresh decision based upon that information. The review was conducted by a member of staff who was not involved with the original request.

The original decision was based upon information provided by the relevant department at the time of your original request. Upon discussions with the reviewing officer, the time required to provide the breakdown was reassessed as less than the statutory threshold. For that reason a new decision was made and the information provided.

We trust this now concludes matters. If you remain dissatisfied, it is open to you to complain to the Information Commissioner's Office who can be contacted at https://ico.org.uk/global/contact-us/

I will, nevertheless, mark the request as closed once a point of clarification is answered: can I take it that any councillor whose name is not listed in the data have made no requests to councillor.net?
