**Subject:** Freedom of Information Request / Subject Access Request and Confirmation of Open Requests

We're waiting for IJ to read a recent response and update the status.

Dear Canterbury City Council Information Governance Team,

I am writing to submit a new Freedom of Information (FOI) request and Subject Access Request (SAR) under the Freedom of Information Act 2000 and General Data Protection Regulation (GDPR). This request focuses on matters of significant public interest and seeks to ensure accountability and transparency in governance.

I also remind the council that all previous FOI and SAR requests submitted by me must be considered open and unresolved until the council provides a substantive explanation justifying how these requests meet the legal threshold for vexatiousness under Section 14 of the FOIA. This principle of unresolved status applies unless and until such justification is independently reviewed and deemed valid.

1. Please provide all correspondence, reports, and memorandums between Canterbury City Council and the East Kent Audit Partnership (EKAP) related to:
- The Milton Manor audit or review.
- Governance discussions or decisions directly involving EKAP from [specific time period, e.g., January 2022 to present].
- Any concerns or disclosures about potential conflicts of interest involving EKAP and senior council officers.

2. Please provide all personal data held by Canterbury City Council relating to:
- Records referencing my previous FOI or SAR submissions.
- Documentation regarding my inclusion or status on any Customer Behavior Incident (CBI) Register.
- Any internal communications or files where I am explicitly mentioned in the context of governance, FOI/SAR handling, or audits.

This request is carefully scoped to avoid duplication and minimize any potential burden on council resources. It addresses outstanding issues that have not been resolved in previous responses.

I request the council to:

- Explicitly justify how any part of this request or any previous requests could reasonably be considered vexatious under Section 14, including a detailed explanation of the application of the public interest test.

- Confirm whether the matters raised in this and previous requests—particularly concerning EKAP’s role in the Milton Manor audit—are recognized as being in the public interest.

Until such time as a thorough and independently validated explanation for the invocation of Section 14 is provided, I maintain that all previous requests remain active and open. As per FOIA and ICO guidelines, I expect the council to take steps to engage constructively and address these concerns without undue delay.

To ensure fairness and clarity:

- Please confirm receipt of this request within the statutory timeframe.

- If any part of this request requires clarification, I am willing to work with the council to refine it.

- If any exemptions are applied, I request a detailed explanation of their application.

Thank you for your attention to this matter. I trust that this request will be handled in the spirit of transparency and accountability. If no satisfactory resolution is provided, I reserve the right to escalate the matter to the Information Commissioner’s Office (ICO).

We have treated this aspect of your request as a request made under the
terms of Freedom of Information Act 2000 and in response, we can advise
that have already responded to your previous request for information
regarding the Milton Manor audit and review and so believe that FOIA2000
s14(2) applies to this aspect of your request which concerns repeat
requests. 
The original response (FOI 21783) was sent on 05 December 2023 following
which you requested a review.
The internal review response (IR 22252) was sent on 24 September 2024.
You have been advised on the steps available to you if you are unhappy
with the council's response and your appeal rights have been provided.
This request will therefore be closed.

information are received, these may be closed without providing a refusal
