Dear Wirral Metropolitan Borough Council,
Can you clarify how many subject access requests made by parents with parental responsibility for their children were rejected by Wirral council since 2014
Dear Mr Osuagwu
We write further to your Freedom of Information request in which you
sought the following information:
"... how many subject access requests made by parents with parental
responsibility for their children were rejected by Wirral council since
Having reviewed the scope of your request, we must advise that the
information requested is not held in a reportable format and would require
a manual extraction exercise which would be likely to exceed the timescale
set by the legislation. Under Section 12 of the Freedom of Information Act
2000, public authorities are not required to comply with a request for
information if it is estimated that to do so would exceed 18.5 hours.
Based upon one years' data, there are 90+ cases and would entail writing a
bespoke report to identify those cases and then allocating 10/15 minutes
to examine each case. For one year alone, this task is estimated to take
approximately 22.5 hours. Wirral Council relies upon the exemption at
Section 12 (1) FOIA to refuse your request.
You have the right under Section 17 of the Freedom of Information Act 2000
to ask for an internal review of the refusal of the information requested.
Please direct any request for an internal review to
[Wirral Borough Council request email] and your request will be allocated to
another officer for review.
If you are dissatisfied with the outcome of an internal review you also
have the right to complain to the information Commissioner, who can be
contacted at https://ico.org.uk/global/contact-us/
