"The Information Commissioner's Office told BuzzFeed News it would not carry out an investigation in response to calls to do so from privacy campaigners, but said that any organisations processing personal data must be transparent with people about how it will be used.

“This can involve setting out clearly and openly what you plan to do with their personal details, for example in a privacy notice," a spokesperson said.

“In certain circumstances, such as if you are processing sensitive personal data about religious beliefs or sexual orientation, a data protection impact assessment should be carried out to demonstrate that the processing complies with the law."

Dear Mr Williams

I am writing further to my correspondence of 07 August 2019 regarding your
request for information received 27 July 2019. I am now in a position to
respond.
 
We have considered your request under the Freedom of Information Act
(FOIA) 2000.

Our response 
 
I confirm that we hold information in scope of your request.
 
Please find attached a series of emails between our Policy and
Communications departments regarding the news story and the comment we
provided in response. I confirm that this is the only information held
which falls in scope of this request.
 
Information contained within the emails, which falls outside the scope of
your request has been removed.
 
There are also a number of instances where I will be withholding
information which constitutes personal data of third parties.
 
Section 40(2) of the Freedom of Information Act 2000 (the FOIA) exempts
information in response to a request if it is personal data belonging to
an individual other than yourself and it satisfies one of the conditions
listed in the legislation.[2][1] The condition contained in section
40(3A)(a) applies - that disclosure would breach one of the data
protection principles. The principle is that -
 
“Personal data shall be processed lawfully, fairly and in a transparent
manner...” [3][2]
 
I do not consider that disclosing this information to you, and
consequently the public, is necessary or justified in order to satisfy
your information request and the requirements of the FOIA. In the
circumstances of this request there is no strong legitimate interest that
would override the prejudice to the rights and freedoms of the data
subject/s. I have therefore withheld this information from our disclosure,
as providing it to you would be unlawful.

This concludes my response to your request. I hope you find the
information provided helpful.
