This questions is in relation to streetworks. This would be any works where Severn Trent have inspected, maintained, adjusted, repaired or altered any relevant pipe which is in, under or over any street.

2017, advising that we did not believe the request fell under the
Environmental Information Regulations and explaining why we had therefore

Unfortunately, it is denied that you have replied to the original request. You have provided a vague description stating that you believe the matter falls outside of the EIR, but have failed to comply with the regulations to provide a formal answer. For the sake of clarity, this response must include the reason the request falls outside EIR and it is your duty to prove the reason for this.

I have made my position in the matter clear in that I believe that the request remains live. If a formal response, which complies with EIR is not received by 20 February, then the matter will be referred to the ICO.

I would welcome you having the opportunity to provide this e-mail trail to the ICO, as it will show your organisation's failure to comply with the Regulations.

Perhaps if this is your final position, and you believe that your organisation has complied with the directions, we should jointly apply to the ICO for their determination?

Following your further request for an internal review of this matter,
Severn Trent Water has already carried out an internal review of your
original request and the outcome of this review was provided to you on 24
February 2017. We are not required to carry out any further internal
reviews under the EIR and if you are unhappy with the outcome of the
internal review, you may raise it with the Information Commissioner’s
Office.

 

Severn Trent Water remains satisfied that it has complied with its
obligations under the EIR in this matter. Nevertheless, we are prepared to
disclose the additional information you have requested voluntarily – but
we do not consider that we are required to do so under the EIR. I
therefore attach a spreadsheet detailing Severn Trent Street Works started
in 2016 which have lasted in excess of two months, with a location. This
represents Severn Trent Water’s final position on this matter, and please
note that we reserve the right to draw this and other correspondence to
the attention of the Information Commission’s Officer in the event of any
future complaint.
