Request relating to: Streetworks undertaken by South East Water

 

1.         Background:

 

Thank you for your request, made pursuant to the Environmental Information
Regulations 2004 (“the Regulations”), dated the 22^nd February 2017 and
received the same date by email, where you requested the following
information:

 

“Please provide a list of all street works that commenced in the month of
January 2017 and last in excess of 28 days.

 

Please ensure this information includes the start date, end date
(provisional if works are on-going) and the location.”

 

This letter will provide the response to your request.

 

2.         South East Water’s Response

 

In accordance with the Regulations, South East Water has a duty to people
requesting information to make ‘Environmental Information’ available,
unless one of the exemptions apply. I would remind you that we only have a
duty to make the information available and not to interpret any of the
information.

 

For ease of reference I set out the definition of Environmental
Information in the Regulations:

 

“Environmental information” means any information in written, visual,
aural, electronic or any other material form on—

(a) the state of the elements of the environment, such as air and
atmosphere, water, soil, land, landscape and natural sites including
wetlands, coastal and marine areas, biological diversity and its
components, including genetically modified organisms, and the interaction
among these elements;

(b) factors, such as substances, energy, noise, radiation or waste,
including radioactive waste, emissions, discharges and other releases into
the environment, affecting or likely to affect the elements of the
environment referred to in (a);

(c) measures (including administrative measures), such as policies,
legislation, plans, programmes, environmental agreements, and activities
affecting or likely to affect the elements and factors referred to in (a)
and (b) as well as measures or activities designed to protect those
elements;

(d) reports on the implementation of environmental legislation;

(e) cost-benefit and other economic analyses and assumptions used within
the framework of the measures and activities referred to in (c); and

(f) the state of human health and safety, including the contamination of
the food chain, where relevant, conditions of human life, cultural sites
and built structures inasmuch as they are or may be affected by the state
of the elements of the environment referred to in (a) or, through those
elements, by any of the matters referred to in (b) and (c).

 

I have looked at your question and considered (i) whether the information
requested is Environmental Information as defined above; and (ii) if it
is, whether any exemption applies or whether it can be disclosed.   

 

South East Water (“SEW”) as a statutory water undertaker has powers to
install, inspect, maintain, repair and replace its apparatus  (notably
water pipes) in streets and in land other than streets, under sections 158
and 159 of the Water Industry Act 1991 respectively. Where such powers
apply in streets, SEW must also comply with the New Roads and Street Works
Act 1991 (“NRSWA”) when carrying out (or directing its contractors to
carry out) these works. In such instances these works are referred to as
streetworks.

 

We consider streetworks to come within part (b) of the definition above as
it is a factor that could have an impact on the environment. It involves
digging up a road and installing or replacing or maintaining water pipes.

 

We also do not consider that any exemption would apply.

 

We therefore set out all of the streetworks that South East Water
undertook which commenced in the month of January 2017 and lasted in
excess of 28 days:

We are entitled to charge a rate of £25.00 per hour in accordance with our
current interim charging scheme for requests for information however we
have not elected to charge for this request.
