I refer to your request regarding street lighting, which was received on
24th November, 2008, which has been dealt with under the Environmental
Information Regulations 2004 as it concerns activities which affect, or
are likely to affect the environment.

I will respond to your request using your numbered points as headings for
ease of reference.

1. The number of street lights are operated by Carmarthenshire County
Council.

Quantity - 18,337.

2.The approximate hours of operation of each street light.

The majority of street lights are on from dusk to dawn (4,100 hrs per
annum).

3.The amount of energy each streetlight uses per hour.

The average energy used per hour is 0.077 kw per lantern.  I would add
that there are a range of lamps of different wattage in use across the
County, ranging from 26w to 400w.

4.The total cost to ratepayers per year in respect of streetlighting in
the County.

The total energy cost for energy, based on the above figure, for the
2007/08 financial year was £558,056.00

5. The steps taken so far to reduce the amounts in 1, 2, 3, and 4 above.

Older street lights are being replaced with more efficient control gear
and street lighting is being supplied with Green Energy.

6. The steps that will be taken in the next year to reduce the amounts in
1, 2, 3 and 4 above.

A task & finish group is being setup to review the number of hours lamps
are current being operated, their quantity and so forth.

I refer to your request for information regarding the work of a task and
finish group reviewing public lighting, which was received on 8th
December, 2008.  We initially advised you that this was being dealt with
under the Freedom of Information Act 2000, however, upon further
consideration, it is evident that the information we hold falls within the
scope of the Environmental Information Regulations 2004 (EIR) as it
concerns measures and activities affecting, or likely to affect, the
environment.  Please accept my apologies for not providing this response
within the 20 working days required by the Regulations.

The specific information you requested was as follows:

1. Whether meeting minutes of the task and finish group are available.

2. What actions have been recommended by the group.

3. A copy of the official brief of the group.

If I may respond to the third part of your request first, the planning and
scoping document prepared for this review which sets out the aims, scope,
timescale etc. is already published on the Council's website and may be
accessed via the following link:

With regard to your request for actions recommended and meeting minutes,
action notes which record the deliberations of the group are held in
relation to two meetings.  However, I have decided to withhold these from
release for reasons I will set out below.

The action notes in question are not published, nor is it intended to
publish them.  They are in my view internal communications to be used by
group members as aides-mémoire of the proceedings, to prepare agendas for
forthcoming meetings and so forth.

Under Regulation 12 (4) (e) of the EIR, a public authority may refuse to
disclose information if it involves the release of internal
communications. Guidance published by the Department for Environment, Food
& Rural Affairs on the EIR states in relation to Regulation 12 (4) (e)
that:

"This exception can apply to information in whatever form it may take,
including memos, notes of meetings  or e-mails."

Having therefore established that this exception is engaged, I am required
to apply the public interest test, that is, to consider whether the public
interest is best served by withholding or releasing the action notes in
question. In doing so, a distinction must be made between what is
genuinely in the public interest and what merely may be of interest to a
member, or members of the public.

The remit of the task and finish group is to consider a range of evidence,
data and issues as well as consulting with internal and external
stakeholders, before producing a report which will be in the public
domain. 

I feel that the public interest lies in ensuring that the group has
adequate time and freedom to properly conduct the review, and an important
part of this is the opportunity to engage in a free and frank exchange of
views before reaching decisions.  This would be compromised by the
publication of the action notes at this stage.

Nonetheless, the EIR build in a presumption of disclosure and I accept
that there is a genuine interest in being informed of the decisions of the
group.  However, in this case, as I have stated above, this will be met by
the publication of a report at the conclusion of the process.

I have therefore determined that the release of action notes, before the
group has had the opportunity to complete its task, would not be in the
public interest and that this exception should be maintained.
