Dear Aberdeenshire Council,

In an article in the Times this week, you are quoted as saying:

“Together with a range of community organisations, we have been looking at ways to improve the look of Stonehaven for the benefit of residents, businesses and visitors.

"An action plan has been created in conjunction with the Stonehaven Town Partnership, Community Council, Stonehaven Business Association and the Horizon Group.

“As part of the action plan we have asked some owners in the area to consider making alterations to their properties. This included asking the owners of The Carron Fish Bar to consider removing their banner."

I am writing to request an internal review of Aberdeenshire Council's handling of my FOI request 'Stonehaven action plan'.

You've redacted the names of businesses even where these are already in the public domain - for example, both "Carron Fish Bar" and "The Bay Fish and Chips" have spoken publicly about receiving the letters: http://www.mearnsleader.co.uk/news/local...

I don't think the argument about negative publicity can apply in circumstances where the businesses have already been named publicly and indeed appear to have chosen to draw attention to themselves.

Ganesh Sittampalam left an annotation ()

The Scottish ICO has ordered disclosure of significant parts of the withheld information, that seems to go beyond what I asked for in my internal review request, by 27th June 2016 in decision 113/2016, which should be published on her website in a week or so.

The decision states "The Commissioner is concerned that a good deal of the information the Council has attempted to withhold in this case relates to the Council itself. There would appear to be no reasonable basis for applying either of the exemptions claimed by the Council to this information. There would appear to be no obvious reason for withholding information of this kind, other than to protect the Council from possible embarrassment. The Commissioner would ask the Council to remember that this is not the purpose of FOISA."
