Please provide statutory powers and legislation that gives all local authority education and Schools per Curriculum for Excellence, the legal authority to teach explicit and inappropriate sexual health and parenthood (RSHP) education to the extent that teachers are producing sex toys in class to children age 16 and under, in schools?
Please advise at what age or equivalent nursery/Primary year/High School year that explicit and inappropriate sexual health and parenthood (RSHP) education commenced in Scotland per CfE?

I refer to your correspondence dated 23 January 2023 requesting
information in relation to statutory powers and legislation that allows
teaching of explicit and inappropriate sexual health and parenthood (RSHP)
education to under 16's per CfE.
The Council is treating your request as a request under the Freedom of
Information (Scotland) Act 2002 and can respond as follows:
· The authority refers to the Scottish Government policy which can

• Local authorities must have regard to the current guidance [2]Conduct
of Relationships, Sexual Health and Parenthood Education in Schools
(2014) in discharging their statutory functions relating to provision
of RSHP education within Curriculum for Excellence (CfE).
• It is issued under section 56 of the [3]Standards in Scotland’s
Schools etc. Act 2000.
• The curriculum is not mandatory, it is up to teachers to decide which
resources they use to deliver relevant and engaging learning. However,
we are specific about the need for children and young people to gain
knowledge appropriate to their age and stage of education
