I am writing to request an internal review of Glasgow City Council's handling of my FOI request 'Statutory powers and legislation that allows teaching of LGBTQ+ to under 16's per CfE'.

The specific information I requested is not available anywhere else as you are referring to non statutory guidance and ‘drivers’ there are no ‘drivers’ stipulated in legislation just the legislation.

Also

***The curriculum is not statutory and therefore it is for teachers, headteachers and other professional educational practitioners to decide the development and implementation of the curriculum within the overall
framework.***

Please note, this URL was also previously enclosed in the Initial Response from the Council on 16 February 2023.

In relation to the second point you have raised, as advised in the review response, some of the questions you have asked in your initial request are not looking for recorded information held by the Council, but rather legal advice. The Freedom of Information (Scotland) Act 2002 provides individuals with access to recorded information held by a Scottish Public Authority, provided no exemptions apply. Since this first part of your request does not fall within the scope of the Act, as advised, the Council will not be progressing with that part of your request.

As detailed in my review response letter dated 16 March 2023, if you remain unhappy with this point, the next step would be to make an appeal application within six months of receipt of that letter for a decision by the Scottish Information Commissioner. You can access the Scottish Information Commissioner’s online appeal service portal to make an application for decision here: www.itspublicknowledge.info/appeal
