I am pleased to give the information you requested and hope that it meets your requirements.

Although amended and changed by subsequent legislation, the core of the mandatory powers invested in a local authority (in relation to the provision of education) are set out in the Education (Scotland) Act 1980. This requires the authority to make provision for progressive education appropriate to the requirements of pupils.

With respect to transitions (as defined in the link provided https://education.gov.scot/parentzone/my...) there are requirements for the local authority to ensure parents are aware of the arrangements that are in place. In general this is achieved through the use of media (social network sites, local press and local broadcaster) along with direct communication between each school/setting and the families enrolled at botyh nursery and school. I am writing regarding your request for a review under Section 20 of the
Freedom of Information (Scotland) Act 2002, relating to your request for
information about legislation and under 16s socially transitioning in
schools.

There is no legislation or statutory powers providing specific authority
for the Education Authority and Schools to socially transition children
under the age of 16.  There is some non-statutory guidance

which would be taken into account by the Education Authority and Schools
in such cases. However this guidance would be applied in the context of
duties established under other legislative frameworks such as the Equality
Act 2010, the Education (Additional Support for Learning) (Scotland) Act
2004 and the Children and Young People (Scotland) Act 2014.

Should the outcome of this review fail to resolve the matter to your
complete satisfaction, you have the right to apply to the Scottish
Information Commissioner for a decision. You have six months in which to
