Denbighshire County Council received 22/10/2024,regarding Assessing
Statutory Nuisance.

As set out by the Environmental Information Regulations 2004 it will be
our aim to respond to your request by 19/11/2024. In some cases, however,
we may be unable to achieve this deadline. If this occurs, we will advise
you of the likely timescale within which the response will be provided.

Under the Environmental Information Regulations, the Council may charge up
to £25 per hour for any access to information requests, and may also
charge for disbursement costs (e.g. photocopies, postage). However, should
there be any such costs, you will be notified of this prior to the
commencement of any work.

what framework is used by officers to assess a statutory nuisance at a
property in Denbighshire.

We would be grateful if you would provide the following clarification: can
you clarify what type of complaint they are referring to? Statutory
nuisance could be in relation to noise, rubbish, smoke, smell etc. Also
can you tell us what you mean by outlining the framework? Do you mean the
process or policy, for example. We are currently not sure what detail to
give and how much detail.

Dear Denbighshire County Council,

I'm writing to clarify this request.

This request asks for information on DCC's response to a situation where a resident has a noise complaint at a residential property in Denbighshire.

I'd like to request detail of the process that is taken by DCC to assess a noise complaint. This includes what steps are taken by DCC to determine whether a noise complaint is a statutory nuisance, and what evidence is needed to establish this. Where there is a document stating the steps taken and the evidence required, I'd like to request this.
