SM-Defra-Information Requests (DEFRA), Department for Environment, Food and Rural Affairs

1 Attachment

Dear Allan Richards

Thank you for your email of 15 May 2022 requesting confirmation of your
understanding of three points relating to the British Waterways Board
Transfer Scheme 2012.  However, as your request does not concern recorded
information that may be held by Defra we are not dealing with it as a
Freedom of Information (FOI) request but handling it as normal
correspondence instead.

Your request follows Defra’s response to your earlier FOI request for a
copy of the Transfer Scheme, and is as set out below:

For the avoidance of doubt, can you please confirm my understanding of
your response. My understanding is that "The British Waterways Board
Transfer Scheme 2012" -

1. Was NOT laid as a Statutory Instrument with either the House of Commons
or House of Lords.

2. Was laid as a "Paper not subject to Parliamentary Proceedings" (rather
than an SI) with the House of Lords on 2 July.

3. Was NOT laid as a "Paper not subject to Parliamentary Proceedings"
(rather than a SI) with the House of Commons.

We can confirm that the British Waterways Board Transfer Scheme 2012 was
not laid as a Statutory Instrument in its own right in either the House of
Lords or the House of Commons, but was an unpublished document
accompanying the British Waterways (Transfer of Functions) Order 2012 (SI
2012 No. 1659), as provided for under section 23 (1)(a) of the Public
Bodies Act 2011.

The Transfer Scheme was laid as a paper not subject to Parliamentary
proceedings in both the House of Lords and the House of Commons on 2 July
2012.  It was recorded in the House of Commons business papers (Votes and
Proceedings) of 2 July 2012 (See under the appendix, ‘Other Papers’, no.
30 ‘Public Bodies’):

[1]House of Commons Votes and Proceedings (Vote Bundle No. 23)
(parliament.uk)

A copy of the formal Defra House of Commons laying letter is also appended
to this letter for information.

Yours sincerely
