Dear Mr Elibank,
I write following your request dated 10 May 2012 (below) under the Freedom of Information Act 2000 for information about the University’s Charter and Statutes, and Court membership.

In response to your questions:

The current Statutes are available at:

The Regulations of the University are currently being updated and not yet ready for publication, therefore this request is refused under Section 22 of the Freedom of Information Act – information intended for future publication: we expect to publish the updated documents by August 2012. However, I can provide the specific new Regulation regarding Court membership as below:

REGULATION 6: THE COURT

1. The Court shall consist of the following persons, namely: -
(a) The Chancellor.
(b) The Vice-Chancellor.
(c) The Pro-Vice-Chancellors.
(d) The Lord-Lieutenants of the Counties of East Sussex and West Sussex.
(e) The High Sheriffs of the Counties of East Sussex and West Sussex.
(f) The Members of the Commons House of Parliament elected for the parliamentary constituencies in the Counties of East Sussex and West Sussex and in the Brighton and Hove Unitary Authority.
(g) Members of Council.
(h) One member of staff from each School of Studies.
(i) Two persons appointed by Council of the County of East Sussex.
(j) Two persons appointed by Council of the County of West Sussex.
(k) Two persons appointed by Brighton and Hove City Council.
(l) One person appointed by Council of each of the Boroughs or Districts of Adur, Arun, Chichester, Crawley, Eastbourne, Hastings, Horsham, Lewes, Mid-Sussex, Rother, Wealden and Worthing.
(m) One representative from local and regional bodies, enterprises and faith communities, learned or professional societies or bodies and local or regional employers.
(n) One representative from each of the University’s Partner Institutions as follows:
Bellerby’s College, London and Brighton
Brighton Institute of Modern Music
Chichester College
Central Sussex College
Croydon College
Highbury College Portsmouth
Roffey Park Institute
Study Group International
West Dean College.
(o) Such other persons as may be appointed by Council.
(p) The Heads of such Colleges of Further and Higher Education in the Counties of East Sussex and West Sussex as follows:
Head of City College Brighton and Hove
Head of Northbrook College
Head of Plumpton College
Head of Sussex Downs College
University of Brighton
University of Chichester.
(q) Director of the Institute of Development Studies.

2. Categories
(a) A person who is appointed by a body, or to represent a body, on the Court need not be a member of the body which appointed him, or her, or which he or she represents.
(b) Members of the Court in category (h) shall continued in membership for a period of one year commencing on 1 August in the year in which they take up their appointment and shall be eligible for re-appointment.
(c) Members of the Court in categories (i) to (o) shall continue in membership for a period of three years commencing on 1st August in the year in which they take up their appointments and shall be eligible for re-appointment; provided that such members who are required to hold a particular qualification or appointment shall be members of the Court only so long as they hold that qualification or appointment.

3. The Court shall hold an Annual Meeting each year at which shall be presented a broad picture of the work of the University including a report by the Vice-Chancellor on the key issues faced by the University during the year following which the Court shall have the opportunity to discuss any matters relating to the University.

I also attach a list of individuals invited to the meeting of Court held this year, and the categories under which they were appointed.

Dear Freedom of Information,

Thank you for your reply dated 6 June 2012.

The version of the Statutes to which you have linked is not a full version. It contains Statutes numbered I, II, III, IV, V, VI, VII and VIII.

However, the Ordinances (which I downloaded from the same page) contain references to a Statute XIII, a Statute XIV, a Statute XXIII and a Statute XXV, for instance.

These Statutes do not appear in the version you linked to, and my Freedom of Information request was for a copy of "the full Statutes," ie. one which is not missing at least two-thirds of them.

Please provide me with the material I requested.

I note your assertion that the copy of the Statues available on the University website is a full copy; if you maintain this, then the internal review will need to focus on the following questions:
— Ordinance II.(6)1, available on the page of the University website to which you directed me, refers to a Statute XXIII. Does this Statute XXIII in fact exist? If not, what is it doing in the Ordinances?
— The same question for Statutes XIII, XIV and XXV, all of which are mentioned in the Ordinances but absent from the 'full' copy with which you provided me.

Following my colleague’s email of 18 June 2012, I have undertaken a review
of the University's approach to responding to your Freedom of Information
enquiry on 12 June 2012 about the University's Charter and Statutes.

I have reviewed your original Freedom of Information request and the
response that was sent to you.  The University has been revising its
statutory documents over the last few months, and as a result our website
had necessarily included some documents which were under revision, and I
apologise if this caused any confusion. For example, the Charter and
Statutes were amended in March 2012 and so the new versions replaced them
on the web in March. The Ordinances were also repealed in March, but many
of the Regulations in the same document remained in force until they too
were revised at our Council meeting a week ago.  I attach for your
information a copy of the Charter and Statutes dated 2009 which contains
the Statutes you refer to in your email i.e. Statutes XXIII, XIII, XIV and
XXV.  We expect to have the new version of the Regulations on our website
very shortly, at which point the Ordinances document will be removed.

 

This email concludes the University's response to your Freedom of
Information request.  If you remain dissatisfied, you have the right of
appeal to the Information Commissioner's Office.  Contact details may be
